| 12 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 12 | | SECTION 1. Section 264.165, Family Code, is amended to read |
|---|
| 14 | 13 | | as follows: |
|---|
| 15 | 14 | | Sec. 264.165. NOTICE REQUIRED FOR EARLY TERMINATION OF |
|---|
| 16 | 15 | | CONTRACT. (a) A single source continuum contractor may terminate a |
|---|
| 17 | 16 | | contract entered into under this subchapter by providing notice to |
|---|
| 18 | 17 | | the department and the commission of the contractor's intent to |
|---|
| 19 | 18 | | terminate the contract not later than the 180th [60th] day before |
|---|
| 20 | 19 | | the date of the termination. |
|---|
| 21 | 20 | | (b) The department may terminate a contract entered into |
|---|
| 22 | 21 | | with a single source continuum contractor under this subchapter by |
|---|
| 23 | 22 | | providing notice to the contractor of the department's intent to |
|---|
| 24 | 23 | | terminate the contract not later than the 180th [30th] day before |
|---|
| 25 | 24 | | the date of termination. |
|---|
| 26 | 25 | | SECTION 2. Section 264.166, Family Code, is amended by |
|---|
| 27 | 26 | | amending Subsection (c) and adding Subsection (d) to read as |
|---|
| 28 | 27 | | follows: |
|---|
| 29 | 28 | | (c) If a single source continuum contractor gives notice to |
|---|
| 30 | 29 | | the department of an early contract termination or the department |
|---|
| 31 | 30 | | gives notice to the contractor of the department's intent to |
|---|
| 32 | 31 | | terminate the contract, the department may enter into a contract |
|---|
| 33 | 32 | | with a different contractor for the sole purpose of assuming the |
|---|
| 34 | 33 | | contract that is being terminated. |
|---|
| 35 | 34 | | (d) Notwithstanding any other law, the department may enter |
|---|
| 36 | 35 | | into a contract with a different single source continuum contractor |
|---|
| 37 | 36 | | under Subsection (c) without following competitive bidding, |
|---|
| 38 | 37 | | advertising, or proposal evaluation requirements, including |
|---|
| 39 | 38 | | requirements under Section 2155.083, 2155.132, or 2155.144, |
|---|
| 40 | 39 | | Government Code, or Section 40.058, Human Resources Code. |
|---|
| 41 | 40 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 42 | 41 | | to a contract entered into or amended, modified, renewed, or |
|---|
| 43 | 42 | | extended on or after the effective date of this Act. A contract |
|---|
| 44 | 43 | | entered into or amended, modified, renewed, or extended before the |
|---|
| 45 | 44 | | effective date of this Act is governed by the law in effect on the |
|---|
| 46 | 45 | | date the contract was entered into or amended, modified, renewed, |
|---|
| 47 | 46 | | or extended, and the former law is continued in effect for that |
|---|
| 48 | 47 | | purpose. |
|---|
| 49 | 48 | | SECTION 4. This Act takes effect September 1, 2025. |
