87 AN ACT
98 relating to certain requirements regarding a contract between a
109 single source continuum contractor and the Department of Family and
1110 Protective Services.
1211 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Section 264.165, Family Code, is amended to read
1413 as follows:
1514 Sec. 264.165. NOTICE REQUIRED FOR EARLY TERMINATION OF
1615 CONTRACT. (a) A single source continuum contractor may terminate a
1716 contract entered into under this subchapter by providing notice to
1817 the department and the commission of the contractor's intent to
1918 terminate the contract not later than the 180th [60th] day before
2019 the date of the termination.
2120 (b) The department may terminate a contract entered into
2221 with a single source continuum contractor under this subchapter by
2322 providing notice to the contractor of the department's intent to
2423 terminate the contract not later than the 180th [30th] day before
2524 the date of termination.
2625 SECTION 2. Section 264.166, Family Code, is amended by
2726 amending Subsection (c) and adding Subsection (d) to read as
2827 follows:
2928 (c) If a single source continuum contractor gives notice to
3029 the department of an early contract termination or the department
3130 gives notice to the contractor of the department's intent to
3231 terminate the contract, the department may enter into a contract
3332 with a different contractor for the sole purpose of assuming the
3433 contract that is being terminated.
3534 (d) Notwithstanding any other law, the department may enter
3635 into a contract with a different single source continuum contractor
3736 under Subsection (c) without following competitive bidding,
3837 advertising, or proposal evaluation requirements, including
3938 requirements under Section 2155.083, 2155.132, or 2155.144,
4039 Government Code, or Section 40.058, Human Resources Code.
4140 SECTION 3. The change in law made by this Act applies only
4241 to a contract entered into or amended, modified, renewed, or
4342 extended on or after the effective date of this Act. A contract
4443 entered into or amended, modified, renewed, or extended before the
4544 effective date of this Act is governed by the law in effect on the
4645 date the contract was entered into or amended, modified, renewed,
4746 or extended, and the former law is continued in effect for that
4847 purpose.
4948 SECTION 4. This Act takes effect September 1, 2025.
