117 A BILL TO BE ENTITLED
128 AN ACT
139 relating to fetal development instruction included as part of the
1410 public school health curriculum in certain grade levels.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. Section 28.002, Education Code, is amended by
1713 adding Subsection (x) to read as follows:
1814 (x) The State Board of Education shall adopt rules requiring
1915 students enrolled in grade levels seven and eight to receive
2016 instruction on fetal development as part of the essential knowledge
2117 and skills for the health curriculum required under Subsection
2218 (a)(2)(B). The board may adopt rules requiring students enrolled
2319 in other grade levels to receive instruction on fetal development.
2420 The instruction must include:
2521 (1) information on:
2622 (A) the human reproductive process, pregnancy,
2723 and infertility; and
2824 (B) the prevention of birth defects, including
2925 information on the effect of drugs, alcohol, and environmental
3026 hazards such as lead; and
3127 (2) a description of the growth and development of an
3228 unborn child that occur during each trimester of pregnancy.
3329 SECTION 2. Section 28.004(c), Education Code, is amended to
3430 read as follows:
3531 (c) The local school health advisory council's duties
3632 include recommending:
3733 (1) the number of hours of instruction to be provided
3834 in:
3935 (A) health education in kindergarten through
4036 grade eight; and
4137 (B) if the school district requires health
4238 education for high school graduation, health education, including
4339 physical health education and mental health education, in grades 9
4440 through 12;
4541 (2) policies, procedures, strategies, and curriculum
4642 appropriate for specific grade levels designed to prevent physical
4743 health concerns, including obesity, cardiovascular disease, Type 2
4844 diabetes, and mental health concerns, including suicide, through
4945 coordination of:
5046 (A) health education, which must address
5147 physical health concerns and mental health concerns to ensure the
5248 integration of physical health education and mental health
5349 education;
5450 (B) physical education and physical activity;
5551 (C) nutrition services;
5652 (D) parental involvement;
5753 (E) instruction on substance abuse prevention;
5854 (F) school health services, including mental
5955 health services;
6056 (G) a comprehensive school counseling program
6157 under Section 33.005;
6258 (H) a safe and healthy school environment; and
6359 (I) school employee wellness;
6460 (3) appropriate grade levels and methods of
6561 instruction for human sexuality instruction;
6662 (4) strategies for integrating the curriculum
6763 components specified by Subdivision (2) with the following elements
6864 in a coordinated school health program for the district:
6965 (A) school health services, including physical
7066 health services and mental health services, if provided at a campus
7167 by the district or by a third party under a contract with the
7268 district;
7369 (B) a comprehensive school counseling program
7470 under Section 33.005;
7571 (C) a safe and healthy school environment; and
7672 (D) school employee wellness;
7773 (5) if feasible, joint use agreements or strategies
7874 for collaboration between the school district and community
7975 organizations or agencies;
8076 (6) strategies to increase parental awareness
8177 regarding:
8278 (A) risky behaviors and early warning signs of
8379 suicide risks and behavioral health concerns, including mental
8480 health disorders and substance use disorders; and
8581 (B) available community programs and services
8682 that address risky behaviors, suicide risks, and behavioral health
8783 concerns;
8884 (7) appropriate grade levels and curriculum for
8985 instruction regarding the dangers of opioids, including
9086 instruction on:
9187 (A) opioid addiction and abuse, including
9288 addiction to and abuse of synthetic opioids such as fentanyl; and
9389 (B) methods of administering an opioid
9490 antagonist, as defined by Section 483.101, Health and Safety Code;
9591 [and]
9692 (8) appropriate grade levels and curriculum for
9793 instruction regarding child abuse, family violence, dating
9894 violence, and sex trafficking, including likely warning signs that
9995 a child may be at risk for sex trafficking, provided that the local
10096 school health advisory council's recommendations under this
10197 subdivision do not conflict with the essential knowledge and skills
10298 developed by the State Board of Education under this subchapter;
10399 and
104100 (9) appropriate curriculum for the instruction on
105101 fetal development described by Section 28.002(x), provided that the
106102 local school health advisory council's recommendations under this
107103 subdivision do not conflict with the essential knowledge and skills
108104 developed by the State Board of Education under this subchapter.
109105 SECTION 3. This Act applies beginning with the 2025-2026
110106 school year.
111107 SECTION 4. This Act takes effect immediately if it receives
112108 a vote of two-thirds of all the members elected to each house, as
113109 provided by Section 39, Article III, Texas Constitution. If this
114110 Act does not receive the vote necessary for immediate effect, this
115111 Act takes effect September 1, 2025.
