77 AN ACT
88 relating to boil water notices issued by public drinking water
99 supply systems.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 341, Health and Safety
1212 Code, is amended by adding Section 341.043 to read as follows:
1313 Sec. 341.043. BOIL WATER NOTICES. (a) The commission shall
1414 require an operator of a public drinking water supply system to
1515 issue a boil water notice not later than 12 hours after the public
1616 drinking water supply system learns of:
1717 (1) a violation by the system of rules adopted by the
1818 commission under this subchapter that creates a significant
1919 potential for human health to be seriously adversely affected; or
2020 (2) a situation that creates a significant potential
2121 for human health to be adversely affected by water from the system.
2222 (b) If the violation or situation has not been resolved 72
2323 hours after the boil water notice was issued, the public drinking
2424 water supply system shall reissue the boil water notice with a
2525 statement describing the actions the public drinking water supply
2626 system is taking to address the violation or situation.
2727 (c) A public drinking water supply system may issue a boil
2828 water notice by any means of direct communication that meets the
2929 requirements of the federal Safe Drinking Water Act (42 U.S.C.
3030 Section 300f et seq.).
3131 SECTION 2. This Act takes effect September 1, 2025.
