69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the operation of vehicles at railroad grade crossings;
912 increasing a criminal penalty.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 545.251(f), Transportation Code, is
1215 amended to read as follows:
1316 (f) An offense under this section is punishable by a fine of
1417 not less than $50 or more than $200, except that the offense is
1518 punishable by a fine of not less than $100 or more than $400 if it is
1619 shown on the trial of the offense that the operator disregarded a
1720 warning given by a flagger under Subsection (a)(2).
1821 SECTION 2. The change in law made by this Act applies only
1922 to an offense committed on or after the effective date of this Act.
2023 An offense committed before the effective date of this Act is
2124 governed by the law in effect on the date the offense was committed,
2225 and the former law is continued in effect for that purpose. For
2326 purposes of this section, an offense was committed before the
2427 effective date of this Act if any element of the offense occurred
2528 before that date.
2629 SECTION 3. This Act takes effect September 1, 2025.
