10 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 14 | | SECTION 1. Section 545.251(f), Transportation Code, is |
---|
12 | 15 | | amended to read as follows: |

13 | 16 | | (f) An offense under this section is punishable by a fine of |
---|
14 | 17 | | not less than $50 or more than $200, except that the offense is |
---|
15 | 18 | | punishable by a fine of not less than $100 or more than $400 if it is |
---|
16 | 19 | | shown on the trial of the offense that the operator disregarded a |
---|
17 | 20 | | warning given by a flagger under Subsection (a)(2). |

18 | 21 | | SECTION 2. The change in law made by this Act applies only |
---|
19 | 22 | | to an offense committed on or after the effective date of this Act. |
---|
20 | 23 | | An offense committed before the effective date of this Act is |

21 | 24 | | governed by the law in effect on the date the offense was committed, |

22 | 25 | | and the former law is continued in effect for that purpose. For |

23 | 26 | | purposes of this section, an offense was committed before the |
