11 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 17 | | SECTION 1. Subchapter A, Chapter 372, Local Government |
---|
13 | 18 | | Code, is amended by adding Section 372.0081 to read as follows: |

14 | 19 | | Sec. 372.0081. ADVISORY BODY MEETINGS BY TELECOMMUNICATION |
---|
15 | 20 | | DEVICE. (a) Notwithstanding any other law, if a member of an |
---|
16 | 21 | | advisory body appointed under Section 372.008 is physically present |
---|
17 | 22 | | at a meeting of the advisory body, any number of the other members |
---|
18 | 23 | | of the advisory body may attend the meeting by use of telephone |
---|
19 | 24 | | conference call, video conference call, or other similar |
---|
20 | 25 | | telecommunication device. A member of the advisory body who |
---|
21 | 26 | | attends a meeting via a telecommunication device is considered |
---|
22 | 27 | | present for purposes of constituting a quorum, voting, and any |
---|
23 | 28 | | other form of participation in the meeting. This subsection |
---|
24 | 29 | | applies regardless of the subject of the meeting or topics |
---|
25 | 30 | | considered at the meeting. |
---|
26 | 31 | | (b) If an advisory body holds a meeting using a |
---|
27 | 32 | | telecommunication device in the manner provided by Subsection (a), |
---|
28 | 33 | | the advisory body must provide two-way audio communication between |
---|
29 | 34 | | board members attending the meeting and, if the two-way audio |
---|
30 | 35 | | communication link with a member is disrupted, stop the meeting |
---|
31 | 36 | | until the link is reestablished. |

32 | 37 | | SECTION 2. Chapter 311, Tax Code, is amended by adding |
---|
33 | 38 | | Section 311.0093 to read as follows: |

35 | 40 | | TELECOMMUNICATION DEVICE. (a) Notwithstanding Chapter 551, |

36 | 41 | | Government Code, or any other law, if the chair or vice chair of the |
---|
37 | 42 | | board of directors of a reinvestment zone is physically present at a |
---|
38 | 43 | | meeting of the board, any number of the other members of the board |
---|
39 | 44 | | may attend the meeting by use of telephone conference call, video |
---|
40 | 45 | | conference call, or other similar telecommunication device. A |
---|
41 | 46 | | member of the board who attends a meeting via a telecommunication |
---|
42 | 47 | | device is considered present for purposes of constituting a quorum, |
---|
43 | 48 | | voting, and any other form of participation in the board meeting. |
---|
44 | 49 | | This subsection applies regardless of the subject of the meeting or |
---|
45 | 50 | | topics considered at the meeting. |
---|
46 | 51 | | (b) If the board holds a meeting using a telecommunication |
---|
47 | 52 | | device in the manner provided by Subsection (a): |
---|
48 | 53 | | (1) the meeting is subject to the notice requirements |
---|
49 | 54 | | for other meetings; |
---|
50 | 55 | | (2) the board must specify in the notice the location |
---|
51 | 56 | | of the meeting at which the chair or vice chair will be physically |
---|
52 | 57 | | present; |
---|
53 | 58 | | (3) the board must make the meeting open and audible to |
---|
54 | 59 | | the public at the location specified under Subdivision (2); and |
---|
55 | 60 | | (4) the board must provide two-way audio communication |
---|
56 | 61 | | between board members attending the meeting and, if the two-way |
---|
57 | 62 | | audio communication link with a member is disrupted, stop the |
---|
58 | 63 | | meeting until the link is reestablished. |
---|
59 | 64 | | SECTION 3. This Act takes effect September 1, 2025. |
