611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the authority of the advisory body of a public
914 improvement district and the board of directors of a reinvestment
1015 zone to hold a meeting by a telecommunication device.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1217 SECTION 1. Subchapter A, Chapter 372, Local Government
1318 Code, is amended by adding Section 372.0081 to read as follows:
1419 Sec. 372.0081. ADVISORY BODY MEETINGS BY TELECOMMUNICATION
1520 DEVICE. (a) Notwithstanding any other law, if a member of an
1621 advisory body appointed under Section 372.008 is physically present
1722 at a meeting of the advisory body, any number of the other members
1823 of the advisory body may attend the meeting by use of telephone
1924 conference call, video conference call, or other similar
2025 telecommunication device. A member of the advisory body who
2126 attends a meeting via a telecommunication device is considered
2227 present for purposes of constituting a quorum, voting, and any
2328 other form of participation in the meeting. This subsection
2429 applies regardless of the subject of the meeting or topics
2530 considered at the meeting.
2631 (b) If an advisory body holds a meeting using a
2732 telecommunication device in the manner provided by Subsection (a),
2833 the advisory body must provide two-way audio communication between
2934 board members attending the meeting and, if the two-way audio
3035 communication link with a member is disrupted, stop the meeting
3136 until the link is reestablished.
3237 SECTION 2. Chapter 311, Tax Code, is amended by adding
3338 Section 311.0093 to read as follows:
3439 Sec. 311.0093. BOARD OF DIRECTORS MEETINGS BY
3540 TELECOMMUNICATION DEVICE. (a) Notwithstanding Chapter 551,
3641 Government Code, or any other law, if the chair or vice chair of the
3742 board of directors of a reinvestment zone is physically present at a
3843 meeting of the board, any number of the other members of the board
3944 may attend the meeting by use of telephone conference call, video
4045 conference call, or other similar telecommunication device. A
4146 member of the board who attends a meeting via a telecommunication
4247 device is considered present for purposes of constituting a quorum,
4348 voting, and any other form of participation in the board meeting.
4449 This subsection applies regardless of the subject of the meeting or
4550 topics considered at the meeting.
4651 (b) If the board holds a meeting using a telecommunication
4752 device in the manner provided by Subsection (a):
4853 (1) the meeting is subject to the notice requirements
4954 for other meetings;
5055 (2) the board must specify in the notice the location
5156 of the meeting at which the chair or vice chair will be physically
5257 present;
5358 (3) the board must make the meeting open and audible to
5459 the public at the location specified under Subdivision (2); and
5560 (4) the board must provide two-way audio communication
5661 between board members attending the meeting and, if the two-way
5762 audio communication link with a member is disrupted, stop the
5863 meeting until the link is reestablished.
5964 SECTION 3. This Act takes effect September 1, 2025.
