77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to coordination between teaching hospitals and medical
1010 schools regarding student field-based experience placements and to
1111 preference in those placements.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1414 amended by adding Section 61.09097 to read as follows:
1515 Sec. 61.09097. COORDINATION OF CLERKSHIPS OR CLINICAL
1616 ROTATIONS REQUIRED. (a) In this section:
1717 (1) "Hospital" has the meaning assigned by Section
1818 241.003, Health and Safety Code.
1919 (2) "Medical school" has the meaning assigned by
2020 Section 58A.001.
2121 (b) The board by rule shall:
2222 (1) require a medical school to coordinate with a
2323 hospital that serves as a teaching hospital for the medical school
2424 through a written agreement regarding placement of the school's
2525 students in required field-based experience positions with the
2626 hospital, such as clerkships or clinical rotations; and
2727 (2) establish a form for use in entering into a written
2828 agreement under Subdivision (1).
2929 SECTION 2. Subchapter A, Chapter 241, Health and Safety
3030 Code, is amended by adding Section 241.014 to read as follows:
3131 Sec. 241.014. PLACEMENT OF STUDENT IN CLERKSHIP OR CLINICAL
3232 ROTATION. (a) In this section, "medical school" has the meaning
3333 assigned by Section 58A.001, Education Code.
3434 (b) A teaching hospital may not charge to a person who is not
3535 a resident of this state a fee for providing a placement in a
3636 field-based experience position, such as a clerkship or clinical
3737 rotation, in an amount that exceeds the amount the hospital charges
3838 to a resident of this state for the placement.
3939 (c) A hospital shall give priority for placement of a
4040 qualified student in a field-based experience position, such as a
4141 clerkship or clinical rotation, in the following order:
4242 (1) a resident of the hospital's community;
4343 (2) a resident of this state; and
4444 (3) a student who is not a resident of this state.
4545 (d) The executive commissioner by rule shall:
4646 (1) require a teaching hospital to coordinate with a
4747 medical school through a written agreement regarding placement with
4848 the hospital of the school's students in required field-based
4949 experience positions, such as clerkships or clinical rotations, in
5050 the manner described in Section 61.09097, Education Code; and
5151 (2) establish guidelines and procedures for
5252 prioritizing students for clerkships or clinical rotations as
5353 provided by Subsection (c).
5454 SECTION 3. Section 61.09097, Education Code, and Section
5555 241.014, Health and Safety Code, as added by this Act, apply
5656 beginning with medical student placements in field-based
5757 experience positions for the 2026-2027 academic year.
5858 SECTION 4. This Act takes effect September 1, 2025.
