| 11 | 11 | | preference in those placements. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 61.09097 to read as follows: |
|---|
| 15 | 15 | | Sec. 61.09097. COORDINATION OF CLERKSHIPS OR CLINICAL |
|---|
| 16 | 16 | | ROTATIONS REQUIRED. (a) In this section: |
|---|
| 17 | 17 | | (1) "Hospital" has the meaning assigned by Section |
|---|
| 18 | 18 | | 241.003, Health and Safety Code. |
|---|
| 19 | 19 | | (2) "Medical school" has the meaning assigned by |
|---|
| 20 | 20 | | Section 58A.001. |
|---|
| 21 | 21 | | (b) The board by rule shall: |
|---|
| 22 | 22 | | (1) require a medical school to coordinate with a |
|---|
| 23 | 23 | | hospital that serves as a teaching hospital for the medical school |
|---|
| 24 | 24 | | through a written agreement regarding placement of the school's |
|---|
| 25 | 25 | | students in required field-based experience positions with the |
|---|
| 26 | 26 | | hospital, such as clerkships or clinical rotations; and |
|---|
| 27 | 27 | | (2) establish a form for use in entering into a written |
|---|
| 28 | 28 | | agreement under Subdivision (1). |

| 29 | 29 | | SECTION 2. Subchapter A, Chapter 241, Health and Safety |
|---|
| 30 | 30 | | Code, is amended by adding Section 241.014 to read as follows: |
|---|
| 31 | 31 | | Sec. 241.014. PLACEMENT OF STUDENT IN CLERKSHIP OR CLINICAL |
|---|
| 32 | 32 | | ROTATION. (a) In this section, "medical school" has the meaning |
|---|
| 33 | 33 | | assigned by Section 58A.001, Education Code. |
|---|
| 34 | 34 | | (b) A teaching hospital may not charge to a person who is not |
|---|
| 35 | 35 | | a resident of this state a fee for providing a placement in a |
|---|
| 36 | 36 | | field-based experience position, such as a clerkship or clinical |
|---|
| 37 | 37 | | rotation, in an amount that exceeds the amount the hospital charges |
|---|
| 38 | 38 | | to a resident of this state for the placement. |
|---|
| 39 | 39 | | (c) A hospital shall give priority for placement of a |
|---|
| 40 | 40 | | qualified student in a field-based experience position, such as a |
|---|
| 41 | 41 | | clerkship or clinical rotation, in the following order: |
|---|
| 42 | 42 | | (1) a resident of the hospital's community; |
|---|
| 43 | 43 | | (2) a resident of this state; and |
|---|
| 44 | 44 | | (3) a student who is not a resident of this state. |
|---|
| 45 | 45 | | (d) The executive commissioner by rule shall: |
|---|
| 46 | 46 | | (1) require a teaching hospital to coordinate with a |
|---|
| 47 | 47 | | medical school through a written agreement regarding placement with |
|---|
| 48 | 48 | | the hospital of the school's students in required field-based |
|---|
| 49 | 49 | | experience positions, such as clerkships or clinical rotations, in |
|---|
| 50 | 50 | | the manner described in Section 61.09097, Education Code; and |
|---|
| 51 | 51 | | (2) establish guidelines and procedures for |
|---|
| 52 | 52 | | prioritizing students for clerkships or clinical rotations as |
|---|
| 53 | 53 | | provided by Subsection (c). |
|---|
| 54 | 54 | | SECTION 3. Section 61.09097, Education Code, and Section |
|---|
| 55 | 55 | | 241.014, Health and Safety Code, as added by this Act, apply |
|---|
| 56 | 56 | | beginning with medical student placements in field-based |
|---|
| 57 | 57 | | experience positions for the 2026-2027 academic year. |
|---|
| 58 | 58 | | SECTION 4. This Act takes effect September 1, 2025. |
