77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to municipal and county regulation of platting and
1010 subdivisions of land.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 212.003(a), Local Government Code, is
1313 amended to read as follows:
1414 (a) In [The governing body of a municipality by ordinance
1515 may extend to the extraterritorial jurisdiction of the municipality
1616 the application of municipal ordinances adopted under Section
1717 212.002 and other municipal ordinances relating to access to public
1818 roads or the pumping, extraction, and use of groundwater by persons
1919 other than retail public utilities, as defined by Section 13.002,
2020 Water Code, for the purpose of preventing the use or contact with
2121 groundwater that presents an actual or potential threat to human
2222 health. However, unless otherwise authorized by state law, in] its
2323 extraterritorial jurisdiction a municipality shall not regulate,
2424 either directly or indirectly:
2525 (1) the use of any building or property for business,
2626 industrial, residential, or other purposes;
2727 (2) the bulk, height, or number of buildings
2828 constructed on a particular tract of land;
2929 (3) the size of a building that can be constructed on a
3030 particular tract of land, including without limitation any
3131 restriction on the ratio of building floor space to the land square
3232 footage;
3333 (4) the minimum size of a lot, dimensions of a lot,
3434 minimum width of a lot frontage, minimum distance a lot must be set
3535 back from a road or property line, or another component of lot
3636 density on a particular tract of land;
3737 (5) the number of residential units that can be built
3838 per acre of land; or
3939 (6) [(5)] the size, type, or method of construction of
4040 a water or wastewater facility that can be constructed to serve a
4141 developed tract of land if[:
4242 [(A)] the facility meets the minimum standards
4343 established for water or wastewater facilities by state and federal
4444 regulatory entities[; and
4545 [(B) the developed tract of land is:
4646 [(i) located in a county with a population
4747 of 2.8 million or more; and
4848 [(ii) served by:
4949 [(a) on-site septic systems
5050 constructed before September 1, 2001, that fail to provide adequate
5151 services; or
5252 [(b) on-site water wells constructed
5353 before September 1, 2001, that fail to provide an adequate supply of
5454 safe drinking water].
5555 SECTION 2. Sections 232.101(a) and (b), Local Government
5656 Code, are amended to read as follows:
5757 (a) By an order adopted and entered in the minutes of the
5858 commissioners court and after a notice is published in a newspaper
5959 of general circulation in the county, the commissioners court may
6060 adopt rules governing plats and subdivisions of land within the
6161 unincorporated area of the county as authorized by this subchapter
6262 [to promote the health, safety, morals, or general welfare of the
6363 county and the safe, orderly, and healthful development of the
6464 unincorporated area of the county].
6565 (b) A [Unless otherwise authorized by state law, a]
6666 commissioners court shall not regulate, either directly or
6767 indirectly [under this section]:
6868 (1) the use of any building or property for business,
6969 industrial, residential, or other purposes;
7070 (2) the bulk, height, or number of buildings
7171 constructed on a particular tract of land;
7272 (3) the size of a building that can be constructed on a
7373 particular tract of land, including without limitation and
7474 restriction on the ratio of building floor space to the land square
7575 footage;
7676 (4) the minimum size of a lot, dimensions of a lot,
7777 minimum width of a lot frontage, minimum distance a lot must be set
7878 back from a road or property line, or another component of lot
7979 density on a particular tract of land;
8080 (5) the number of residential units that can be built
8181 per acre of land;
8282 (6) [(5)] a plat or subdivision in an adjoining
8383 county; or
8484 (7) [(6)] road access to a plat or subdivision in an
8585 adjoining county.
8686 SECTION 3. Sections 232.103 and 232.104, Local Government
8787 Code, are repealed.
8888 SECTION 4. The changes in law made by this Act apply only to
8989 a plat application filed on or after the effective date of this Act.
9090 A plat application filed before the effective date of this Act is
9191 governed by the law in effect on the date the application was filed,
9292 and the former law is continued in effect for that purpose.
9393 SECTION 5. This Act takes effect immediately if it receives
9494 a vote of two-thirds of all the members elected to each house, as
9595 provided by Section 39, Article III, Texas Constitution. If this
9696 Act does not receive the vote necessary for immediate effect, this
9797 Act takes effect September 1, 2025.
