711 A BILL TO BE ENTITLED
812 AN ACT
913 relating to required reports of certain vaccine-related or
1014 drug-related adverse events.
1115 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1216 SECTION 1. Subchapter A, Chapter 161, Health and Safety
1317 Code, is amended by adding Section 161.0103 to read as follows:
1418 Sec. 161.0103. REQUIRED REPORT OF CERTAIN VACCINE-RELATED
1519 ADVERSE EVENTS. (a) In this section, "serious adverse event" means
1620 an event that:
1721 (1) results in death;
1822 (2) is considered life-threatening;
1923 (3) results in inpatient hospitalization or an
2024 extension of the duration of an existing hospitalization;
2125 (4) results in a persistent or significant incapacity
2226 or substantial disruption of an individual's ability to perform
2327 normal life functions;
2428 (5) results in a congenital anomaly or birth defect;
2529 or
2630 (6) results in a medically important condition that,
2731 based on the physician's reasonable medical judgment, may require
2832 medical or surgical intervention to prevent an outcome described by
2933 Subdivisions (1) through (5).
3034 (b) This section applies only to a vaccine that is:
3135 (1) experimental or investigational; or
3236 (2) approved or authorized for emergency use by the
3337 United States Food and Drug Administration.
3438 (c) Notwithstanding Subsection (b), this section does not
3539 apply to a vaccine administered as part of a clinical trial.
3640 (d) Notwithstanding any other law, a physician shall report
3741 to the federal Vaccine Adverse Event Reporting System any serious
3842 adverse event the physician's patient suffers if:
3943 (1) the physician:
4044 (A) diagnoses the patient with a condition
4145 related to the serious adverse event; and
4246 (B) knows the patient received a vaccination to
4347 which this section applies; and
4448 (2) the patient suffers the serious adverse event
4549 before the first anniversary of the date the patient was
4650 vaccinated.
4751 (e) A physician who violates this section is subject to:
4852 (1) for an initial violation, non-disciplinary
4953 corrective action by the Texas Medical Board; and
5054 (2) for each subsequent violation, disciplinary
5155 action by the Texas Medical Board as if the physician violated
5256 Subtitle B, Title 3, Occupations Code.
5357 (f) For purposes of non-disciplinary corrective action or
5458 disciplinary action imposed under Subsection (e), the Texas Medical
5559 Board may not consider a violation of this section after the third
5660 anniversary of the date of the violation. The Texas Medical Board
5761 shall retain information on each violation of this section in the
5862 physician's permanent record.
5963 (g) The executive commissioner shall adopt rules necessary
6064 to implement this section.
6165 SECTION 2. Subchapter E, Chapter 431, Health and Safety
6266 Code, is amended by adding Section 431.1145 to read as follows:
6367 Sec. 431.1145. REQUIRED REPORT OF CERTAIN DRUG-RELATED
6468 ADVERSE EVENTS. (a) In this section, "serious adverse event" means
6569 an event that:
6670 (1) results in death;
6771 (2) is considered life-threatening;
6872 (3) results in inpatient hospitalization or an
6973 extension of the duration of an existing hospitalization;
7074 (4) results in a persistent or significant incapacity
7175 or substantial disruption of an individual's ability to perform
7276 normal life functions;
7377 (5) results in a congenital anomaly or birth defect;
7478 or
7579 (6) results in a medically important medical condition
7680 that, based on the physician's reasonable medical judgment, may
7781 require medical or surgical intervention to prevent an outcome
7882 described by Subdivisions (1) through (5).
7983 (b) This section applies only to a drug that is:
8084 (1) experimental or investigational; or
8185 (2) approved or authorized for emergency use by the
8286 United States Food and Drug Administration.
8387 (c) Notwithstanding Subsection (b), this section does not
8488 apply to a drug that is administered or used as part of a clinical
8589 trial.
8690 (d) Notwithstanding any other law, a physician shall report
8791 to the United States Food and Drug Administration through the
8892 MedWatch reporting program any serious adverse event the
8993 physician's patient suffers if:
9094 (1) the physician:
9195 (A) diagnoses the patient with a condition
9296 related to the serious adverse event; and
9397 (B) knows the patient was administered or used a
9498 drug to which this section applies; and
9599 (2) the patient suffers the serious adverse event
96100 before the first anniversary of the date the patient was
97101 administered or used the drug.
98102 (e) A physician who violates this section is subject to:
99103 (1) for an initial violation, non-disciplinary
100104 corrective action by the Texas Medical Board; and
101105 (2) for each subsequent violation, disciplinary
102106 action by the Texas Medical Board as if the physician violated
103107 Subtitle B, Title 3, Occupations Code.
104108 (f) For purposes of non-disciplinary corrective action or
105109 disciplinary action imposed under Subsection (e), the Texas Medical
106110 Board may not consider a violation of this section after the third
107111 anniversary of the date of the violation. The Texas Medical Board
108112 shall retain information on each violation of this section in the
109113 physician's permanent record.
110114 (g) The executive commissioner shall adopt rules necessary
111115 to implement this section.
112116 SECTION 3. As soon as practicable after the effective date
113117 of this Act, the executive commissioner of the Health and Human
114118 Services Commission shall adopt rules necessary to implement the
115119 changes in law made by this Act.
116120 SECTION 4. This Act takes effect September 1, 2025.
