77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the requirement that certain state employees conduct
1010 agency business only at the employee's regular place of employment.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 658.010, Government Code, is amended to
1313 read as follows:
1414 Sec. 658.010. PLACE WHERE WORK PERFORMED. (a) This section
1515 does not apply to the Supreme Court of Texas, the Texas Court of
1616 Criminal Appeals, a court of appeals, or another agency in the
1717 judicial branch.
1818 (b) Except as provided by Subsection (d), an [An] employee
1919 of a state agency shall[, during normal office hours,] conduct
2020 agency business only at the employee's regular [or assigned
2121 temporary] place of employment [unless the employee:
2222 [(1) is travelling; or
2323 [(2) received prior written authorization from the
2424 administrative head of the employing state agency to perform work
2525 elsewhere].
2626 (c) A state agency may not implement, maintain, or authorize
2727 a permanent policy that allows an agency employee to conduct agency
2828 business at a place other than the employee's regular place of
2929 employment except as provided by this section or specifically
3030 authorized by other law.
3131 (d) A state agency may authorize an agency employee to
3232 conduct agency business at a place other than the employee's
3333 regular place of employment only if:
3434 (1) the administrative head of the agency approves the
3535 authorization in writing; and
3636 (2) at least one of the following applies:
3737 (A) the governor has declared a state of disaster
3838 under Chapter 418;
3939 (B) the employee is on approved medical leave or
4040 has a documented disability that requires a reasonable
4141 accommodation to comply with the Americans with Disabilities Act of
4242 1990 (42 U.S.C. Section 12101 et seq.);
4343 (C) the employee's primary job responsibilities
4444 require frequent travel to or work at locations other than the
4545 employee's regular place of employment;
4646 (D) the employee performs work or provides
4747 services that require the employee to work at a location other than
4848 the employee's regular place of employment in order to:
4949 (i) respond to a cybersecurity threat; or
5050 (ii) conduct essential maintenance of
5151 information technology equipment; or
5252 (E) the authorization is approved by the office
5353 of the governor.
5454 (e) A state agency shall report any authorization provided
5555 under Subsection (d) to the state auditor's office as soon as
5656 practicable after the authorization is provided.
5757 (f) [(b)] The employee's personal residence may not be
5858 considered the employee's regular [or assigned temporary] place of
5959 employment [without prior written authorization from the
6060 administrative head of the employing state agency].
6161 (g) Not later than October 1 of each year, each state agency
6262 shall submit a written report to the state auditor's office that
6363 includes documentation of:
6464 (1) agency employee attendance and adherence to the
6565 requirements of this section;
6666 (2) each authorization provided under Subsection (d);
6767 and
6868 (3) any corrective measures taken by the agency to
6969 address noncompliance with the requirements of this section.
7070 SECTION 2. Each state agency to which Section 658.010,
7171 Government Code, as amended by this Act, applies shall submit the
7272 initial report required by that section not later than October 1,
7373 2026.
7474 SECTION 3. This Act takes effect October 1, 2025.
