A BILL TO BE ENTITLED
AN ACT
relating to prosecutor access to a police officer's personnel file.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 143.089(h), Local Government Code, is
amended to read as follows:
(h) The following are entitled to view the contents of a
police officer's personnel file maintained under Subsection (g):
(1) as [As] provided by Section 1701.451, Occupations
Code, a law enforcement agency hiring the [a police] officer; and
(2) a prosecuting attorney's office conducting a
criminal investigation of the officer [is entitled to view the
contents of the officer's personnel file maintained under
Subsection (g)].
SECTION 2. This Act takes effect September 1, 2025.
