108 AN ACT
119 relating to prohibiting the possession or consumption of alcoholic
1210 beverages on the premises of certain sexually oriented businesses;
1311 creating a criminal offense; providing a criminal penalty.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. The heading to Chapter 105, Alcoholic Beverage
1614 Code, is amended to read as follows:
1715 CHAPTER 105. [HOURS OF] SALE AND CONSUMPTION OF ALCOHOLIC
1816 BEVERAGES; HOURS AND OTHER RESTRICTIONS
1917 SECTION 2. Chapter 105, Alcoholic Beverage Code, is amended
2018 by adding Section 105.092 to read as follows:
2119 Sec. 105.092. CONSUMPTION AT CERTAIN SEXUALLY ORIENTED
2220 BUSINESSES PROHIBITED. (a) In this section:
2321 (1) "Nude" means:
2422 (A) entirely unclothed; or
2523 (B) clothed in a manner that leaves uncovered or
2624 visible through less than fully opaque clothing any portion of the
2725 breasts below the top of the areola of the breasts, if the person is
2826 female, or any portion of the genitals or buttocks.
2927 (2) "Sexually oriented business" means a nightclub,
3028 bar, restaurant, or similar commercial enterprise that provides for
3129 an audience of two or more individuals live nude entertainment or
3230 live nude performances.
3331 (b) A person who operates a sexually oriented business that
3432 does not hold a permit or license under this code may not allow a
3533 person to:
3634 (1) consume alcoholic beverages on the business's
3735 premises; or
3836 (2) bring alcoholic beverages onto or possess
3937 alcoholic beverages on the business's premises for the purpose of
4038 consumption on the premises.
4139 (c) A person described by Subsection (b) or that person's
4240 agent commits an offense if the person or that person's agent allows
4341 a person to:
4442 (1) consume alcoholic beverages on the business's
4543 premises; or
4644 (2) bring alcoholic beverages onto or possess
4745 alcoholic beverages on the business's premises for the purpose of
4846 consumption on the premises.
4947 (d) A first offense under this section is a Class A
5048 misdemeanor.
5149 (e) If it is shown on the trial of an offense under this
5250 section that the person has previously been finally convicted of
5351 one offense under this section, on conviction the person shall be
5452 punished for a state jail felony.
5553 (f) If it is shown on the trial of an offense under this
5654 section that the person has previously been finally convicted of
5755 two or more offenses under this section, on conviction the person
5856 shall be punished for a third degree felony.
5957 SECTION 3. This Act takes effect September 1, 2025.
