89R5359 KRM-D By: Cook S.B. No. 2894 A BILL TO BE ENTITLED AN ACT relating to a school district policy regarding custodian workloads. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 38, Education Code, is amended by adding Section 38.042 to read as follows: Sec. 38.042. CUSTODIAN WORKLOAD POLICY. (a) The board of trustees of each school district shall adopt a policy regarding custodian workload for district facilities. The policy must establish benchmarks for the amount of square feet that may be assigned to a properly equipped school custodian for maintenance and custodial services during an eight-hour shift. (b) The board must provide benchmarks under Subsection (a) categorized by elementary, middle, and high school campuses, and other district facilities. (c) The school district shall post the policy adopted under this section on the school district's Internet website. SECTION 2. This Act applies beginning with the 2025-2026 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2025.
