| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 29, Education Code, is amended by adding |
|---|
| 13 | 13 | | Subchapter J to read as follows: |

| 14 | 14 | | SUBCHAPTER J. EDUCATION SAVINGS ACCOUNT PROGRAM |
|---|
| 15 | 15 | | Sec. 29.3511. DEFINITION OF PROGRAM. For purposes of |
|---|
| 16 | 16 | | Section 29.3551, "program" means the education savings account |
|---|
| 17 | 17 | | program established under S.B. 2, Acts of the 89th Legislature, |
|---|
| 18 | 18 | | Regular Session, 2025. This section expires September 1, 2026. |
|---|
| 19 | 19 | | Sec. 29.3551. ELIGIBILITY OF CHILDREN OF CERTAIN ELECTED |
|---|
| 20 | 20 | | OFFICIALS. Notwithstanding any other provision of this subchapter, |
|---|
| 21 | 21 | | a child is not eligible to participate in the program during the |
|---|
| 22 | 22 | | period in which the child's parent or legal guardian is a state |
|---|
| 23 | 23 | | representative, state senator, or statewide elected official. |
|---|
| 24 | 24 | | SECTION 2. This Act applies beginning with the 2026-2027 |
|---|
| 25 | 25 | | school year. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2025. |
