711 A BILL TO BE ENTITLED
812 AN ACT
913 relating to establishing a child-care services waiting list
1014 priority for the children of certain child-care workers.
1115 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1216 SECTION 1. Subchapter A, Chapter 302, Labor Code, is
1317 amended by adding Section 302.0064 to read as follows:
1418 Sec. 302.0064. CHILD-CARE SERVICES WAITING LIST PRIORITY
1519 FOR CHILD-CARE WORKERS. (a) For purposes of this section,
1620 "child-care worker" means an individual employed by and working in
1721 a child-care facility licensed under Chapter 42, Human Resources
1822 Code, for a minimum of 25 hours per week. The term does not include
1923 the owner or director of a child-care facility unless the owner's or
2024 director's child is served in a program other than a program
2125 directly supervised by the owner or director.
2226 (b) The commission shall require that any waiting list for
2327 child-care services must establish a priority position for the
2428 delivery of those services to children of child-care workers who
2529 are eligible for the services.
2630 (c) A child-care worker whose child receives a priority
2731 position on a waitlist as provided by Subsection (b) is subject to
2832 redetermination of the individual's eligibility for services in
2933 accordance with commission rule each year.
3034 SECTION 2. This Act takes effect September 1, 2025.
