| 11 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 16 | | SECTION 1. Subchapter A, Chapter 302, Labor Code, is |

| 13 | 17 | | amended by adding Section 302.0064 to read as follows: |

| 14 | 18 | | Sec. 302.0064. CHILD-CARE SERVICES WAITING LIST PRIORITY |
|---|
| 15 | 19 | | FOR CHILD-CARE WORKERS. (a) For purposes of this section, |
|---|
| 16 | 20 | | "child-care worker" means an individual employed by and working in |
|---|
| 17 | 21 | | a child-care facility licensed under Chapter 42, Human Resources |
|---|
| 18 | 22 | | Code, for a minimum of 25 hours per week. The term does not include |
|---|
| 19 | 23 | | the owner or director of a child-care facility unless the owner's or |
|---|
| 20 | 24 | | director's child is served in a program other than a program |
|---|
| 21 | 25 | | directly supervised by the owner or director. |
|---|
| 22 | 26 | | (b) The commission shall require that any waiting list for |
|---|
| 23 | 27 | | child-care services must establish a priority position for the |
|---|
| 24 | 28 | | delivery of those services to children of child-care workers who |
|---|
| 25 | 29 | | are eligible for the services. |
|---|
| 26 | 30 | | (c) A child-care worker whose child receives a priority |
|---|
| 27 | 31 | | position on a waitlist as provided by Subsection (b) is subject to |
|---|
| 28 | 32 | | redetermination of the individual's eligibility for services in |
|---|
| 29 | 33 | | accordance with commission rule each year. |
|---|
| 30 | 34 | | SECTION 2. This Act takes effect September 1, 2025. |
