128 AN ACT
139 relating to prohibiting an officer or employee of this state or of a
1410 political subdivision of this state from distributing certain voter
15- registration application forms; creating a criminal offense.

1612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1713 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1814 amended by adding Section 13.009 to read as follows:
19- Sec. 13.009. DISTRIBUTION OF APPLICATION; OFFENSE. (a)
20- Except as otherwise provided by a provision of this code, including
21- provisions of this chapter and Chapter 20, an officer or employee of
22- this state or of a political subdivision of this state may not

16+ provided by Subsection (c) or Subchapter B, an officer or employee
17+ of this state or of a political subdivision of this state may not
2318 distribute a form on which a person may apply for registration to a
2419 person who did not request it.
2520 (b) An officer or employee of this state or of a political
2621 subdivision of this state may not use public funds to facilitate the
27- distribution by another person of a form the officer or employee
28- would be prohibited from distributing under Subsection (a).
29- (c) Notwithstanding Subsection (a), a political party or a
30- candidate for office may distribute a form described by Subsection
22+ distribution by another person of a form described by Subsection
3123 (a) to a person who did not request it.
32- (d) An officer or employee of this state or of a political
33- subdivision of this state commits an offense if the officer or
34- employee violates Subsection (a) or (b).
35- (e) An offense under this section is a Class A misdemeanor.
24+ (c) A political party or a candidate for office may
25+ distribute a form described by Subsection (a) to a person who did
26+ not request it.
3627 SECTION 2. This Act takes effect September 1, 2025.
