| 11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 11 | | SECTION 1. Chapter 250, Local Government Code, is amended |
|---|
| 13 | 12 | | by adding Section 250.014 to read as follows: |

| 14 | 13 | | Sec. 250.014. GROUP DAY-CARE HOME AND FAMILY HOME |
|---|
| 15 | 14 | | REGULATORY CERTAINTY. A political subdivision may not adopt or |
|---|
| 16 | 15 | | enforce an ordinance, order, or other measure that requires a group |
|---|
| 17 | 16 | | day-care home or family home licensed, registered, or listed under |
|---|
| 18 | 17 | | Chapter 42, Human Resources Code, to comply with health and safety |
|---|
| 19 | 18 | | standards that exceed the standards established by statute or |
|---|
| 20 | 19 | | Health and Human Services Commission rule. |
|---|
| 21 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 24 | | Act takes effect September 1, 2025. |
