69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to requiring independent school districts, home-rule
912 school districts, and open-enrollment charter schools to comply
1013 with legally required policies.
1114 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1215 SECTION 1. Subchapter B, Chapter 11, Education Code, is
1316 amended by adding Section 11.012 to read as follows:
1417 Sec. 11.012. REQUIREMENT REGARDING THE ADOPTION OF A
1518 POLICY. Any requirement of law that imposes a duty to adopt a
1619 policy imposes a duty on the school district, board of trustees, and
1720 school district personnel to implement and act in accordance with
1821 the policy requirements.
1922 SECTION 2. Section 12.013, Education Code, is amended by
2023 adding Subsection (c) to read as follows:
2124 (c) Any requirement of law that imposes a duty to adopt a
2225 policy imposes a duty on the home-rule school district, its
2326 governing body, and school personnel to implement and act in
2427 accordance with the policy requirements.
2528 SECTION 3. Section 12.056, Education Code, is amended by
2629 adding Subsection (c) to read as follows:
2730 (c) Any requirement of law that imposes a duty to adopt a
2831 policy imposes a duty on the campus charter school, its governing
2932 body, and its school personnel to implement and act in accordance
3033 with the policy requirements.
3134 SECTION 4. Section 12.104, Education Code, is amended by
3235 adding Subsection (e) to read as follows:
3336 (e) Any requirement of law that imposes a duty to adopt a
3437 policy imposes a duty on the open-enrollment charter school, its
3538 governing body, and its school personnel to implement and act in
3639 accordance with the policy requirements.
3740 SECTION 5. This Act takes effect immediately if it receives
3841 a vote of two-thirds of all the members elected to each house, as
3942 provided by Section 39, Article III, Texas Constitution. If this
4043 Act does not receive the vote necessary for immediate effect, this
4144 Act takes effect September 1, 2025.
