| 9 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 13 | | SECTION 1. Section 701.151(b), Occupations Code, is amended |
|---|
| 11 | 14 | | to read as follows: |
|---|
| 12 | 15 | | (b) The commission or the department, as appropriate, |
|---|
| 13 | 16 | | shall: |
|---|
| 14 | 17 | | (1) adopt and publish a code of ethics; |
|---|
| 15 | 18 | | (2) establish the qualifications [and fitness] of |
|---|
| 16 | 19 | | applicants for licenses, including renewed and reciprocal |
|---|
| 17 | 20 | | licenses; and |
|---|
| 18 | 21 | | (3) request and receive any necessary assistance from |
|---|
| 19 | 22 | | state educational institutions or other state agencies. |
|---|
| 20 | 23 | | SECTION 2. Section 701.251(b), Occupations Code, is amended |
|---|
| 21 | 24 | | to read as follows: |
|---|
| 22 | 25 | | (b) Unless the person holds an appropriate license issued |
|---|
| 23 | 26 | | under this chapter, a person may not: |
|---|
| 24 | 27 | | (1) use the title or represent or imply that the person |
|---|
| 25 | 28 | | has the title "licensed dietitian" [or "provisional licensed |
|---|
| 26 | 29 | | dietitian"] or use the letters "LD" [or "PLD"]; or |
|---|
| 27 | 30 | | (2) use a facsimile of that title [those titles] to |
|---|
| 28 | 31 | | indicate or imply that the person is a licensed dietitian [or |
|---|
| 29 | 32 | | provisional licensed dietitian]. |
|---|
| 30 | 33 | | SECTION 3. Section 701.304, Occupations Code, is amended to |
|---|
| 31 | 34 | | read as follows: |
|---|
| 32 | 35 | | Sec. 701.304. GROUNDS FOR REFUSING RENEWAL. The commission |
|---|
| 33 | 36 | | or department may refuse to renew the license of a person who fails |
|---|
| 34 | 37 | | to pay an administrative penalty imposed against the person under |
|---|
| 35 | 38 | | Subchapter F, Chapter 51 [K], unless enforcement of the penalty is |
|---|
| 36 | 39 | | stayed or a court has ordered that the administrative penalty is not |
|---|
| 37 | 40 | | owed. |

| 38 | 41 | | SECTION 4. The following provisions of the Occupations Code |
|---|
| 39 | 42 | | are repealed: |
|---|
| 40 | 43 | | (1) Section 701.002(9); |
|---|
| 41 | 44 | | (2) Section 701.1511; and |
|---|
| 42 | 45 | | (3) Section 701.403. |
|---|
| 43 | 46 | | SECTION 5. This Act takes effect September 1, 2025. |
