69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the licensing and regulation of dietitians.
912 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1013 SECTION 1. Section 701.151(b), Occupations Code, is amended
1114 to read as follows:
1215 (b) The commission or the department, as appropriate,
1316 shall:
1417 (1) adopt and publish a code of ethics;
1518 (2) establish the qualifications [and fitness] of
1619 applicants for licenses, including renewed and reciprocal
1720 licenses; and
1821 (3) request and receive any necessary assistance from
1922 state educational institutions or other state agencies.
2023 SECTION 2. Section 701.251(b), Occupations Code, is amended
2124 to read as follows:
2225 (b) Unless the person holds an appropriate license issued
2326 under this chapter, a person may not:
2427 (1) use the title or represent or imply that the person
2528 has the title "licensed dietitian" [or "provisional licensed
2629 dietitian"] or use the letters "LD" [or "PLD"]; or
2730 (2) use a facsimile of that title [those titles] to
2831 indicate or imply that the person is a licensed dietitian [or
2932 provisional licensed dietitian].
3033 SECTION 3. Section 701.304, Occupations Code, is amended to
3134 read as follows:
3235 Sec. 701.304. GROUNDS FOR REFUSING RENEWAL. The commission
3336 or department may refuse to renew the license of a person who fails
3437 to pay an administrative penalty imposed against the person under
3538 Subchapter F, Chapter 51 [K], unless enforcement of the penalty is
3639 stayed or a court has ordered that the administrative penalty is not
3740 owed.
3841 SECTION 4. The following provisions of the Occupations Code
3942 are repealed:
4043 (1) Section 701.002(9);
4144 (2) Section 701.1511; and
4245 (3) Section 701.403.
4346 SECTION 5. This Act takes effect September 1, 2025.
