| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 233.061, Local Government Code, is |
|---|
| 13 | 13 | | amended by amending Subsection (b) and adding Subsection (c) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (b) The commissioners court of a county that adopts a fire |
|---|
| 16 | 16 | | code under Subsection (a) [, or any municipality in the county,] may |
|---|
| 17 | 17 | | contract with a municipality located in the county or an emergency |
|---|
| 18 | 18 | | services district located wholly in the county [one another] for |
|---|
| 19 | 19 | | the administration and enforcement of the fire code. |
|---|
| 20 | 20 | | (c) An emergency services district that has adopted a fire |
|---|
| 21 | 21 | | code and that is wholly located in one county may enter into an |
|---|
| 22 | 22 | | interlocal agreement with the county to delegate to the district |
|---|
| 23 | 23 | | all or part of the county's authority to enforce the county's fire |
|---|
| 24 | 24 | | code. |

| 25 | 25 | | SECTION 2. Section 352.019, Local Government Code, is |
|---|
| 26 | 26 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
|---|
| 27 | 27 | | read as follows: |
|---|
| 28 | 28 | | (a) Except as provided by Subsection (a-1), the [The] county |
|---|
| 29 | 29 | | fire marshal shall enforce all state and county regulations that |
|---|
| 30 | 30 | | relate to fires, explosions, or damages of any kind caused by a fire |
|---|
| 31 | 31 | | or explosion. |
|---|
| 32 | 32 | | (a-1) The county fire marshal shall delegate the |
|---|
| 33 | 33 | | administration and enforcement of the county's fire code to a |
|---|
| 34 | 34 | | municipality or emergency services district in accordance with a |
|---|
| 35 | 35 | | contract entered into by the commissioners court of the county |
|---|
| 36 | 36 | | under Section 233.061. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2025. |
