69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the recognition of a handgun license issued by another
912 state.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 411.173(b), Government Code, is amended
1215 to read as follows:
1316 (b) A valid license to carry a handgun issued by any other
1417 state is recognized in this state. The governor shall negotiate [an
1518 agreement] with any other state an agreement that provides for the
1619 reciprocal recognition [issuance] of a license to carry a handgun
1720 if the other state requires such an agreement before recognizing a
1821 license to carry a handgun issued by this state [under which a
1922 license issued by the other state is recognized in this state or
2023 shall issue a proclamation that a license issued by the other state
2124 is recognized in this state if the attorney general of the State of
2225 Texas determines that a background check of each applicant for a
2326 license issued by that state is initiated by state or local
2427 authorities or an agent of the state or local authorities before the
2528 license is issued. For purposes of this subsection, "background
2629 check" means a search of the National Crime Information Center
2730 database and the Interstate Identification Index maintained by the
2831 Federal Bureau of Investigation]. The department shall publish on
2932 its Internet website and annually update a list of states in which a
3033 license to carry a handgun issued by this state is recognized.
3134 SECTION 2. Sections 411.173(c) and (d), Government Code,
3235 are repealed.
3336 SECTION 3. This Act takes effect immediately if it receives
3437 a vote of two-thirds of all the members elected to each house, as
3538 provided by Section 39, Article III, Texas Constitution. If this
3639 Act does not receive the vote necessary for immediate effect, this
3740 Act takes effect September 1, 2025.
