10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 16 | | SECTION 1. Subchapter C, Chapter 552, Government Code, is |

12 | 17 | | amended by adding Section 552.164 to read as follows: |

13 | 18 | | Sec. 552.164. EXCEPTION: CONFIDENTIALITY OF INFORMATION |

14 | 19 | | REGARDING FRAUD DETECTION AND DETERRENCE MEASURES. (a) |
---|
15 | 20 | | Information in the custody of a governmental body that relates to |
---|
16 | 21 | | fraud detection and deterrence measures is confidential and |
---|
17 | 22 | | excepted from the requirements of Section 552.021. For purposes of |
---|
18 | 23 | | this section, fraud detection information includes risk |
---|
19 | 24 | | assessments, reports, data, protocols, technology specifications, |
---|
20 | 25 | | manuals, instructions, investigative materials, crossmatches, |
---|
21 | 26 | | mental impressions, and communications that may reveal the methods |
---|
22 | 27 | | or means by which a governmental body prevents, investigates, or |
---|
23 | 28 | | evaluates fraud. |
---|
24 | 29 | | (b) The confidentiality protection provided by Subsection |
---|
25 | 30 | | (a) does not affect the ability of a governmental body to share |
---|
26 | 31 | | information described by Subsection (a) as authorized by other law |
---|
27 | 32 | | for law enforcement and fraud detection and prevention purposes. |
---|
28 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
