611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the confidentiality of fraud detection and deterrence
914 information under the public information law.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1217 amended by adding Section 552.164 to read as follows:
1318 Sec. 552.164. EXCEPTION: CONFIDENTIALITY OF INFORMATION
1419 REGARDING FRAUD DETECTION AND DETERRENCE MEASURES. (a)
1520 Information in the custody of a governmental body that relates to
1621 fraud detection and deterrence measures is confidential and
1722 excepted from the requirements of Section 552.021. For purposes of
1823 this section, fraud detection information includes risk
1924 assessments, reports, data, protocols, technology specifications,
2025 manuals, instructions, investigative materials, crossmatches,
2126 mental impressions, and communications that may reveal the methods
2227 or means by which a governmental body prevents, investigates, or
2328 evaluates fraud.
2429 (b) The confidentiality protection provided by Subsection
2530 (a) does not affect the ability of a governmental body to share
2631 information described by Subsection (a) as authorized by other law
2732 for law enforcement and fraud detection and prevention purposes.
2833 SECTION 2. This Act takes effect September 1, 2025.
