| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 39A.111, Education Code, is amended to | |
| 13 | 13 | read as follows: | |
| 14 | 14 | Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING. | |
| 15 | 15 | If a campus is considered to have an unacceptable performance | |
| 16 | 16 | rating for five consecutive school years, the commissioner, subject | |
| 17 | 17 | to Section 39A.112, may [shall] order: | |
| 18 | 18 | (1) appointment of a board of managers to govern the | |
| 19 | 19 | school district as provided by Section 39A.202; [or] | |
| 20 | 20 | (2) closure of the campus; or | |
| 21 | 21 | (3) any action authorized under Section 39A.002. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2025. |
