77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the essential knowledge and skills for the public
1010 school foundation curriculum and social studies curriculum.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 28.002(h-1) and (h-2), Education Code,
1313 are amended to read as follows:
1414 (h-1) In adopting the essential knowledge and skills for the
1515 foundation curriculum under Subsection (a)(1), the State Board of
1616 Education shall, as appropriate, adopt essential knowledge and
1717 skills that develop each student's civic knowledge, including an
1818 understanding of:
1919 (1) the fundamental moral, political, and
2020 intellectual foundations of the American experiment in
2121 self-government;
2222 (2) the history, qualities, traditions, and features
2323 of civic engagement in the United States;
2424 (3) the structure, organization, function, and
2525 processes of government institutions at the federal, state, and
2626 local levels; and
2727 (4) the founding documents of the United States,
2828 including:
2929 (A) the entirety of the Declaration of
3030 Independence;
3131 (B) the entirety of the United States
3232 Constitution;
3333 (C) the Federalist Papers, including the
3434 entirety of Essays 10, [and] 51, and 78;
3535 (D) excerpts from Marbury v. Madison, 5 U.S. 137
3636 (1803);
3737 (E) excerpts from Alexis de Tocqueville's
3838 Democracy in America;
3939 (F) [(E)] the transcript of the first
4040 Lincoln-Douglas debate;
4141 (G) [(F)] the writings of the founding fathers of
4242 the United States;
4343 (H) [(G)] the entirety of Frederick Douglass's
4444 speeches "The Meaning of July Fourth for the Negro" and "What the
4545 Black Man Wants"; and
4646 (I) [(H)] the entirety of Martin Luther King
4747 Jr.'s speech "I Have a Dream."
4848 (h-2) In adopting the essential knowledge and skills for the
4949 social studies curriculum for each grade level from kindergarten
5050 through grade 12, the State Board of Education shall adopt
5151 essential knowledge and skills that develop each student's civic
5252 knowledge, including:
5353 (1) an understanding of:
5454 (A) the fundamental moral, political,
5555 entrepreneurial, and intellectual foundations of the American
5656 experiment in self-government;
5757 (B) the history, qualities, traditions, and
5858 features of civic engagement in the United States;
5959 (C) the structure, organization, function, and
6060 processes of government institutions at the federal, state, and
6161 local levels, with an emphasis on:
6262 (i) the structure of the federal court
6363 system and the court system of this state;
6464 (ii) the role the judiciary, as a co-equal
6565 branch of government, plays in providing checks and balances on
6666 governmental power;
6767 (iii) the selection of judicial
6868 officeholders within the federal and state judicial systems, with
6969 special consideration given to state and local officeholders of
7070 this state;
7171 (iv) the processing and flow of cases at all
7272 court levels in this state;
7373 (v) the role judges and juries play in the
7474 criminal and civil justice systems; and
7575 (vi) the sharing of governance between the
7676 federal and state governments in a federalist system and the
7777 interplay between the judicial examination of legal issues at the
7878 federal and state level; and
7979 (D) the founding documents of the United States;
8080 (2) the ability to:
8181 (A) analyze and determine the reliability of
8282 information sources;
8383 (B) formulate and articulate reasoned positions;
8484 (C) understand the manner in which local, state,
8585 and federal government works and operates through the use of
8686 simulations and models of governmental and democratic processes;
8787 (D) actively listen and engage in civil
8888 discourse, including discourse with those with different
8989 viewpoints; and
9090 (E) participate as a citizen in a constitutional
9191 democracy by voting; and
9292 (3) an appreciation of:
9393 (A) the importance and responsibility of
9494 participating in civic life;
9595 (B) a commitment to the United States and its
9696 form of government; and
9797 (C) a commitment to free speech and civil
9898 discourse.
9999 SECTION 2. This Act applies beginning with the 2025-2026
100100 school year.
101101 SECTION 3. This Act takes effect immediately if it receives
102102 a vote of two-thirds of all the members elected to each house, as
103103 provided by Section 39, Article III, Texas Constitution. If this
104104 Act does not receive the vote necessary for immediate effect, this
105105 Act takes effect September 1, 2025.
