77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a public hearing requirement for a proposal by the
1010 governor or the Legislative Budget Board to affect appropriations
1111 and certain actions of the governor during a state of disaster.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 317.005, Government Code, is amended by
1414 amending Subsections (a) and (b) and adding Subsection (a-1) to
1515 read as follows:
1616 (a) After a [governor's] proposal under this chapter is
1717 published in the Texas Register, the Legislative Budget Board shall
1818 [may] conduct a public hearing on the proposal. The board shall
1919 give notice of a hearing under this section in the manner provided
2020 by law for notice of regular meetings of the board. The board also
2121 shall provide notice by mail of its meetings to each member of the
2222 Legislature. The notice of the meeting must include a description
2323 of the nature of the proposal or order to be considered. [If the
2424 agenda includes a public hearing on a proposal, the notice must so
2525 state.]
2626 (a-1) After a hearing under Subsection (a) and at a meeting
2727 held not less than 10 days after the date notice of the meeting was
2828 given in the manner provided for regular board meetings, in
2929 response to a [governor's] proposal by the governor, the board,
3030 subject to the restrictions provided by Subsection (e), may:
3131 (1) ratify the proposal by adopting an order changing
3232 the relevant appropriation in the manner specified in the proposal;
3333 (2) reject the proposal; or
3434 (3) recommend changes in the proposal.
3535 (b) After a hearing under Subsection (a), in [In] response
3636 to a proposal by the board, the governor may take any action
3737 specified by Subsection (a-1) [(a)] for board action on a
3838 [governor's] proposal by the governor.
3939 SECTION 2. Section 418.012, Government Code, is amended to
4040 read as follows:
4141 Sec. 418.012. EXECUTIVE ORDERS. (a) Under this chapter,
4242 the governor may issue executive orders, proclamations, and
4343 regulations and amend or rescind them. Executive orders,
4444 proclamations, and regulations have the force and effect of law.
4545 (b) The governor shall limit an executive order,
4646 proclamation, or regulation issued, amended, or rescinded under
4747 this chapter to address only the specific conditions or
4848 requirements of the disaster or imminent disaster that is the
4949 subject of an executive order or proclamation under Section
5050 418.014(a).
5151 (c) Not later than Monday of each week during a declared
5252 disaster, the governor shall publish on the governor's Internet
5353 website a list in chronological order of all executive orders,
5454 proclamations, and regulations issued, amended, or rescinded by the
5555 governor under this chapter during the previous seven-day period.
5656 SECTION 3. Section 418.057, Government Code, is amended to
5757 read as follows:
5858 Sec. 418.057. DISASTER WEB PORTAL. (a) The division shall
5959 develop a comprehensive disaster web portal. The web portal must:
6060 (1) provide disaster information to the public,
6161 including information on programs and services available to
6262 disaster victims and funding for and expenditures of disaster
6363 assistance programs;
6464 (2) include information on disaster response and
6565 recovery activities; and
6666 (3) provide information on obtaining assistance from
6767 the Federal Emergency Management Agency, state agencies, organized
6868 volunteer groups, and any other entities providing disaster
6969 assistance.
7070 (b) Not later than Monday of each week during a declared
7171 disaster, the division shall publish on the web portal a list in
7272 chronological order of all executive orders, proclamations, and
7373 regulations issued, amended, or rescinded by the governor under
7474 this chapter during the previous seven-day period.
7575 SECTION 4. Section 317.005, Government Code, as amended by
7676 this Act, applies only to a proposal under Chapter 317, Government
7777 Code, made on or after the effective date of this Act. A proposal
7878 under Chapter 317, Government Code, made before the effective date
7979 of this Act is governed by the law in effect when the proposal was
8080 made, and the former law is continued in effect for that purpose.
8181 SECTION 5. This Act takes effect September 1, 2025.
