---|
9 | 9 | | relating to a public hearing requirement for a proposal by the |
---|
10 | 10 | | governor or the Legislative Budget Board to affect appropriations |
---|
11 | 11 | | and certain actions of the governor during a state of disaster. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Section 317.005, Government Code, is amended by |
---|
14 | 14 | | amending Subsections (a) and (b) and adding Subsection (a-1) to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | (a) After a [governor's] proposal under this chapter is |
---|
17 | 17 | | published in the Texas Register, the Legislative Budget Board shall |
---|
18 | 18 | | [may] conduct a public hearing on the proposal. The board shall |
---|
19 | 19 | | give notice of a hearing under this section in the manner provided |
---|
20 | 20 | | by law for notice of regular meetings of the board. The board also |
---|
21 | 21 | | shall provide notice by mail of its meetings to each member of the |
---|
22 | 22 | | Legislature. The notice of the meeting must include a description |
---|
23 | 23 | | of the nature of the proposal or order to be considered. [If the |
---|
24 | 24 | | agenda includes a public hearing on a proposal, the notice must so |
---|
25 | 25 | | state.] |
---|
26 | 26 | | (a-1) After a hearing under Subsection (a) and at a meeting |
---|
27 | 27 | | held not less than 10 days after the date notice of the meeting was |
---|
28 | 28 | | given in the manner provided for regular board meetings, in |
---|
29 | 29 | | response to a [governor's] proposal by the governor, the board, |
---|
30 | 30 | | subject to the restrictions provided by Subsection (e), may: |
---|
31 | 31 | | (1) ratify the proposal by adopting an order changing |
---|
32 | 32 | | the relevant appropriation in the manner specified in the proposal; |
---|
33 | 33 | | (2) reject the proposal; or |
---|
34 | 34 | | (3) recommend changes in the proposal. |
---|
35 | 35 | | (b) After a hearing under Subsection (a), in [In] response |
---|
36 | 36 | | to a proposal by the board, the governor may take any action |
---|
37 | 37 | | specified by Subsection (a-1) [(a)] for board action on a |
---|
38 | 38 | | [governor's] proposal by the governor. |
---|
39 | 39 | | SECTION 2. Section 418.012, Government Code, is amended to |
---|
40 | 40 | | read as follows: |
---|
41 | 41 | | Sec. 418.012. EXECUTIVE ORDERS. (a) Under this chapter, |
---|
42 | 42 | | the governor may issue executive orders, proclamations, and |
---|
43 | 43 | | regulations and amend or rescind them. Executive orders, |
---|
44 | 44 | | proclamations, and regulations have the force and effect of law. |
---|
45 | 45 | | (b) The governor shall limit an executive order, |
---|
46 | 46 | | proclamation, or regulation issued, amended, or rescinded under |
---|
47 | 47 | | this chapter to address only the specific conditions or |
---|
48 | 48 | | requirements of the disaster or imminent disaster that is the |
---|
49 | 49 | | subject of an executive order or proclamation under Section |
---|
50 | 50 | | 418.014(a). |
---|
51 | 51 | | (c) Not later than Monday of each week during a declared |
---|
52 | 52 | | disaster, the governor shall publish on the governor's Internet |
---|
53 | 53 | | website a list in chronological order of all executive orders, |
---|
54 | 54 | | proclamations, and regulations issued, amended, or rescinded by the |
---|
55 | 55 | | governor under this chapter during the previous seven-day period. |
---|
56 | 56 | | SECTION 3. Section 418.057, Government Code, is amended to |
---|
57 | 57 | | read as follows: |
---|
58 | 58 | | Sec. 418.057. DISASTER WEB PORTAL. (a) The division shall |
---|
59 | 59 | | develop a comprehensive disaster web portal. The web portal must: |
---|
60 | 60 | | (1) provide disaster information to the public, |
---|
61 | 61 | | including information on programs and services available to |
---|
62 | 62 | | disaster victims and funding for and expenditures of disaster |
---|
63 | 63 | | assistance programs; |
---|
64 | 64 | | (2) include information on disaster response and |
---|
65 | 65 | | recovery activities; and |
---|
66 | 66 | | (3) provide information on obtaining assistance from |
---|
67 | 67 | | the Federal Emergency Management Agency, state agencies, organized |
---|
68 | 68 | | volunteer groups, and any other entities providing disaster |
---|
69 | 69 | | assistance. |
---|
70 | 70 | | (b) Not later than Monday of each week during a declared |
---|
71 | 71 | | disaster, the division shall publish on the web portal a list in |
---|
72 | 72 | | chronological order of all executive orders, proclamations, and |
---|
73 | 73 | | regulations issued, amended, or rescinded by the governor under |
---|
74 | 74 | | this chapter during the previous seven-day period. |
---|
75 | 75 | | SECTION 4. Section 317.005, Government Code, as amended by |
---|
76 | 76 | | this Act, applies only to a proposal under Chapter 317, Government |
---|
77 | 77 | | Code, made on or after the effective date of this Act. A proposal |
---|
78 | 78 | | under Chapter 317, Government Code, made before the effective date |
---|
79 | 79 | | of this Act is governed by the law in effect when the proposal was |
---|
80 | 80 | | made, and the former law is continued in effect for that purpose. |
---|
81 | 81 | | SECTION 5. This Act takes effect September 1, 2025. |
---|
