| 11 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 17 | | SECTION 1. Section 411.0728(a), Government Code, is amended |
|---|
| 13 | 18 | | to read as follows: |
|---|
| 14 | 19 | | (a) This section applies only to a person: |
|---|
| 15 | 20 | | (1) who is convicted of or placed on deferred |
|---|
| 16 | 21 | | adjudication community supervision for: |
|---|
| 17 | 22 | | (A) a misdemeanor [an offense] under: |
|---|
| 18 | 23 | | (i) Subchapter D, Chapter 481 [(A) Section |
|---|
| 19 | 24 | | 481.120], Health and Safety Code[, if the offense is punishable |
|---|
| 20 | 25 | | under Subsection (b)(1)]; or |
|---|
| 21 | 26 | | (ii) [(B) Section 481.121, Health and |
|---|
| 22 | 27 | | Safety Code, if the offense is punishable under Subsection (b)(1); |
|---|
| 23 | 28 | | [(C)] Section 30.05, 31.03, 37.10, or 49.02, |
|---|
| 24 | 29 | | Penal Code[, if the offense is punishable under Subsection (e)(1) |
|---|
| 25 | 30 | | or (2)]; or |
|---|
| 26 | 31 | | (B) an offense under [(D)] Section 43.02, Penal |
|---|
| 27 | 32 | | Code; and |
|---|
| 28 | 33 | | (2) who, if requested by the applicable law |
|---|
| 29 | 34 | | enforcement agency or prosecuting attorney to provide assistance in |
|---|
| 30 | 35 | | the investigation or prosecution of an offense under Section |
|---|
| 31 | 36 | | 20A.02, 20A.03, or 43.05, Penal Code, or a federal offense |
|---|
| 32 | 37 | | containing elements that are substantially similar to the elements |
|---|
| 33 | 38 | | of an offense under any of those sections: |
|---|
| 34 | 39 | | (A) provided assistance in the investigation or |
|---|
| 35 | 40 | | prosecution of the offense; or |
|---|
| 36 | 41 | | (B) did not provide assistance in the |
|---|
| 37 | 42 | | investigation or prosecution of the offense due to the person's age |
|---|
| 38 | 43 | | or a physical or mental disability resulting from being a victim of |
|---|
| 39 | 44 | | an offense described by this subdivision. |
|---|
| 40 | 45 | | SECTION 2. This Act takes effect September 1, 2025. |
