611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the eligibility of certain victims of trafficking of
914 persons or compelling prostitution for an order of nondisclosure of
1015 criminal history record information.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1217 SECTION 1. Section 411.0728(a), Government Code, is amended
1318 to read as follows:
1419 (a) This section applies only to a person:
1520 (1) who is convicted of or placed on deferred
1621 adjudication community supervision for:
1722 (A) a misdemeanor [an offense] under:
1823 (i) Subchapter D, Chapter 481 [(A) Section
1924 481.120], Health and Safety Code[, if the offense is punishable
2025 under Subsection (b)(1)]; or
2126 (ii) [(B) Section 481.121, Health and
2227 Safety Code, if the offense is punishable under Subsection (b)(1);
2328 [(C)] Section 30.05, 31.03, 37.10, or 49.02,
2429 Penal Code[, if the offense is punishable under Subsection (e)(1)
2530 or (2)]; or
2631 (B) an offense under [(D)] Section 43.02, Penal
2732 Code; and
2833 (2) who, if requested by the applicable law
2934 enforcement agency or prosecuting attorney to provide assistance in
3035 the investigation or prosecution of an offense under Section
3136 20A.02, 20A.03, or 43.05, Penal Code, or a federal offense
3237 containing elements that are substantially similar to the elements
3338 of an offense under any of those sections:
3439 (A) provided assistance in the investigation or
3540 prosecution of the offense; or
3641 (B) did not provide assistance in the
3742 investigation or prosecution of the offense due to the person's age
3843 or a physical or mental disability resulting from being a victim of
3944 an offense described by this subdivision.
4045 SECTION 2. This Act takes effect September 1, 2025.
