4024 This Act may be cited as the ‘‘Licensing Individual 4
4125 Commercial Exam-takers Now Safely and Efficiently Act 5
4226 of 2023’’ or the ‘‘LICENSE Act of 2023’’. 6
43-SEC. 2. MODIFICATIONS TO CERTAIN COMMERCIAL DRIV-7
44-ER’S LICENSE REGULATIONS. 8
45-Not later than 90 days after the date of enactment 9
46-of this Act, the Secretary of Transportation, acting 10
47-through the Administrator of the Federal Motor Carrier 11
48-Safety Administration, shall— 12
49-(1) revise section 384.228 of title 49, Code of 13
50-Federal Regulations (or a successor regulation), to 14
51-allow a State or third-party examiner to administer 15
52-the commercial driver’s license knowledge test only 16
53-if the examiner— 17
54-(A) maintains a valid commercial driver’s 18
55-license test examiner certification; 19
56-(B) completes a commercial driver’s license 20
57-skills test examiner training course that meets 21
58-the requirements of subsection (d) of such sec-22
59-tion; and 23
60-(C) completes 1 unit of instruction de-24
61-scribed in subsection (c)(3) of such section; and 25
