Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Licensing Individual 4
Commercial Exam-takers Now Safely and Efficiently Act 5
of 2023’’ or the ‘‘LICENSE Act of 2023’’. 6
SEC. 2. MODIFICATIONS TO CERTAIN COMMERCIAL DRIV-7
ER’S LICENSE REGULATIONS. 8
Not later than 90 days after the date of enactment 9
of this Act, the Secretary of Transportation, acting 10
through the Administrator of the Federal Motor Carrier 11
Safety Administration, shall— 12
(1) revise section 384.228 of title 49, Code of 13
Federal Regulations (or a successor regulation), to 14
allow a State or third-party examiner to administer 15
the commercial driver’s license knowledge test only 16
if the examiner— 17
(A) maintains a valid commercial driver’s 18
license test examiner certification; 19
(B) completes a commercial driver’s license 20
skills test examiner training course that meets 21
the requirements of subsection (d) of such sec-22
tion; and 23
(C) completes 1 unit of instruction de-24
scribed in subsection (c)(3) of such section; and 25

(2) revise section 383.79 of title 49, Code of 1
Federal Regulations (or a successor regulation), to 2
allow a State to administer a driving skills tests to 3
any commercial driver’s license applicant, regardless 4
of the State of domicile of the applicant or where the 5
applicant received driver training. 6
