To amend title 18, United States Code, to increase certain 
penalties for assaulting, resisting, or impeding certain 
officers or employees. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Patrick Underwood 4
Federal Law Enforcement Protection Act of 2023’’. 5
SEC. 2. ASSAULTING, RESISTING, OR IMPEDING CERTAIN 6
OFFICERS OR EMPLOYEES. 7
Section 111 of title 18, United States Code, is 8
amended to read as follows: 9

‘‘§ 111. Assaulting, resisting, or impeding certain offi-1
cers or employees 2
‘‘(a) I
NGENERAL.—Whoever knowingly— 3
‘‘(1) forcibly assaults, resists, opposes, impedes, 4
intimidates, or interferes while performing official 5
duties, 6
‘‘(2) makes physical contact with or has the in-7
tent to commit another felony while acting under 8
paragraph (1), or 9
‘‘(3) uses a deadly or dangerous weapon against 10
(including a weapon intended to cause death or dan-11
ger but that fails to do so by reason of a defective 12
component) or inflicts bodily injury while acting 13
under paragraph (1), 14
any officer or employee of the United States or of any 15
agency in any branch of the United States Government 16
(including any member of the uniformed services) while 17
engaged in or on account of the performance of official 18
duties, or any person who formerly served as a person de-19
fined above on account of the performance of official du-20
ties during such person’s term of service shall be punished 21
as provided in subsection (b). 22
‘‘(b) P
UNISHMENT.—A violation of subsection (a) 23
shall be punished as follows: 24
‘‘(1) For a violation of paragraph (1) of such 25
subsection, by a fine under this title of not less than 26

$1,000 or by imprisonment for not more than 1 1
year, or both. 2
‘‘(2) For a violation of paragraph (2) of such 3
subsection, by a fine under this title of not less than 4
$2,500 or by imprisonment for not more than 10 5
years, or both. 6
‘‘(3) For a violation of paragraph (3) of such 7
subsection, by a fine under this title of not less than 8
$10,000 or by mandatory imprisonment, or both.’’. 9
