a firearm or ammunition by a user of medical marijuana,
and for other purposes.

SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Second Amendment 4
Protection Act’’. 5

SEC. 2. EXEMPTIONS FOR MEDICAL MARIHAUNA USE FROM 1
GROUNDS FOR FIREARM AND AMMUNITION 2

(a) E
XEMPTION FOR MEDICALMARIHUANA.—Sec-4
tion 922 of title 18, United States Code, is amended— 5
(1) in subsection (d)(3), by inserting before the 6
semicolon the following: ‘‘(except that an individual 7
shall not be treated as an unlawful user of or ad-8
dicted to any controlled substance based on the indi-9
vidual using marihuana for a medical purpose in ac-10
cordance with State law)’’; and 11
(2) in subsection (g)(3), by inserting before the 12
semicolon the following: ‘‘(except that an individual 13
shall not be treated as an unlawful user of or ad-14
dicted to any controlled substance based on the indi-15
vidual using marihuana for a medical purpose in ac-16
cordance with State law)’’. 17
(b) E
FFECTIVEDATE.—The amendments made by 18
this section shall take effect 90 days after the date of en-19
actment of this Act. 20
