Oligarch Act of 2023

Impact

The implementation of HB 4919 is expected to have a transformational impact on tax policy by altering how wealth is taxed in the United States. This can significantly influence state laws regarding personal income taxation and wealth accumulation. Additionally, the bill mandates stringent reporting requirements and provides for the potential extension of tax payment deadlines for those facing liquidity constraints. This could create a more comprehensive system for wealth tax enforcement and compliance, possibly leading to increased audits of high-net-worth individuals who are elicited under this new taxation structure.

Summary

House Bill 4919, known as the 'Oligarch Act of 2023', proposes significant amendments to the Internal Revenue Code by establishing a wealth tax aimed at individuals and certain trusts. The tax is calculated based on the net value of taxable assets held by the taxpayer on the last day of each calendar year. A tiered tax structure is proposed, starting at 2% for net assets exceeding a specific threshold, increasing progressively to 8% for those with significant wealth. This bill seeks to introduce a new revenue stream by targeting affluent individuals, hinting at a broader effort to address wealth inequality and ensure that large fortunes contribute fairly to public finances.

Contention

The bill has sparked vigorous debate concerning its feasibility and implications. Proponents argue it could generate substantial revenue for government services and promote a more equitable distribution of wealth. Critics, however, warn about potential adverse effects, including discouraging investment, business growth, and innovation among the wealthy whose capital is crucial for economic dynamism. The methodology for asset valuation is also a contentious point, as determining the accurate worth of various asset classes—especially non-liquid assets or those without easily ascertainable values—poses complex challenges that could complicate compliance and enforcement.

US HB25

FairTax Act of 2023 This bill imposes a national sales tax on the use or consumption in the United States of taxable property or services in lieu of the current income taxes, payroll taxes, and estate and gift taxes. The rate of the sales tax will be 23% in 2025, with adjustments to the rate in subsequent years. There are exemptions from the tax for used and intangible property; for property or services purchased for business, export, or investment purposes; and for state government functions. Under the bill, family members who are lawful U.S. residents receive a monthly sales tax rebate (Family Consumption Allowance) based upon criteria related to family size and poverty guidelines. The states have the responsibility for administering, collecting, and remitting the sales tax to the Treasury. Tax revenues are to be allocated among (1) the general revenue, (2) the old-age and survivors insurance trust fund, (3) the disability insurance trust fund, (4) the hospital insurance trust fund, and (5) the federal supplementary medical insurance trust fund. No funding is authorized for the operations of the Internal Revenue Service after FY2027. Finally, the bill terminates the national sales tax if the Sixteenth Amendment to the Constitution (authorizing an income tax) is not repealed within seven years after the enactment of this bill.
