4545 ered item that contains perfluorooctane sulfonate 15
4646 (PFOS) or perfluorooctanoic acid (PFOA). 16

4848 OVERED ITEM DEFINED .—In this sub-17
4949 section, the term ‘covered item’ means— 18
5050 ‘‘(A) nonstick cookware or cooking utensils 19
5151 for use in galleys or dining facilities; and 20
5252 ‘‘(B) upholstered furniture, carpets, and 21
5353 rugs that have been treated with stain-resistant 22

9494 ULE OF CONSTRUCTION .—Nothing in 3
9595 this subsection shall be construed as— 4
9696 ‘‘(A) requiring the disposal of, or otherwise 5
9797 affecting, covered items acquired by the Sec-6
9898 retary of Defense prior to April 1, 2025; or 7
9999 ‘‘(B) imposing an obligation on the Sec-8
100100 retary to test covered items to confirm the ab-9
101101 sence of perfluoroalkyl substances or 10
102102 polyfluoroalkyl substances. 11

104104 EFINITIONS.—In this subsection: 12
105105 ‘‘(A) The term ‘covered item’ means— 13
106106 ‘‘(i) non-stick cookware or food service 14
107107 ware for use in galleys or dining facilities; 15
108108 ‘‘(ii) food packaging materials; 16
109109 ‘‘(iii) cleaning products, including 17
110110 floor waxes; 18
111111 ‘‘(iv) carpeting; 19
112112 ‘‘(v) rugs, curtains, or upholstered 20
113113 furniture; 21
114114 ‘‘(vi) sunscreen; 22
115115 ‘‘(vii) shoes and clothing for which 23
116116 treatment with a perfluoroalkyl substance 24

125125 means a man-made chemical of which all of the 6
126126 carbon atoms are fully fluorinated carbon 7

128128 ‘‘(C) The term ‘polyfluoroalkyl substance’ 9
129129 means a man-made chemical containing at least 10
130130 one fully fluorinated carbon atom and at least 11
131131 one nonfluorinated carbon atom.’’. 12

135135 EPORTS.—Not later than 270 days after 14
136136 the date of the enactment of this Act, and annually 15
137137 thereafter, the Secretary of Defense shall submit to 16
138138 the Committees on Armed Services of the House of 17
139139 Representatives and the Senate a report containing 18
140140 a detailed description of the following: 19
141141 (A) Steps taken to identify covered items 20
142142 acquired by the Secretary of Defense that con-21
143143 tain or are produced using perfluoroalkyl sub-22
144144 stances or polyfluoroalkyl substances. 23
145145 (B) Steps taken to limit the acquisition by 24
146146 the Secretary of covered items that contain or 25
