22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘PFAS Free Military 4
24	24	Purchasing Act’’. 5

33	33	fense Authorization Act for Fiscal Year 2021 (Public Law 5
34	34	116–283; 10 U.S.C. 3062 note; 134 Stat. 3531) is amend-6
35	35	ed to read as follows: 7
36	36	‘‘SEC. 333. RESTRICTION ON DEPARTMENT OF DEFENSE AC-8
37	37	QUISITION OF COVERED ITEMS CONTAINING 9
38	38	OR PRODUCED USING CERTAIN SUBSTANCES. 10

40	40	ROHIBITIONBEGINNINGAPRIL1, 2023.— 11
41	41	‘‘(1) P
42	42	ROHIBITION.—During the period begin-12
43	43	ning on April 1, 2023, and ending on April 1, 2025, 13
44	44	the Secretary of Defense may not acquire any cov-14
45	45	ered item that contains perfluorooctane sulfonate 15
46	46	(PFOS) or perfluorooctanoic acid (PFOA). 16
47	47	‘‘(2) C
48	48	OVERED ITEM DEFINED .—In this sub-17
49	49	section, the term ‘covered item’ means— 18
50	50	‘‘(A) nonstick cookware or cooking utensils 19
51	51	for use in galleys or dining facilities; and 20
52	52	‘‘(B) upholstered furniture, carpets, and 21
53	53	rugs that have been treated with stain-resistant 22
54	54	coatings. 23

84	84	MPLEMENTATION.—In carrying out this 21
85	85	subsection, the Secretary shall include the prohibi-22
86	86	tion under paragraph (1) as a term in any contract 23
87	87	or other agreement entered into on or after April 1, 24

94	94	ULE OF CONSTRUCTION .—Nothing in 3
95	95	this subsection shall be construed as— 4
96	96	‘‘(A) requiring the disposal of, or otherwise 5
97	97	affecting, covered items acquired by the Sec-6
98	98	retary of Defense prior to April 1, 2025; or 7
99	99	‘‘(B) imposing an obligation on the Sec-8
100	100	retary to test covered items to confirm the ab-9
101	101	sence of perfluoroalkyl substances or 10
102	102	polyfluoroalkyl substances. 11
103	103	‘‘(4) D
104	104	EFINITIONS.—In this subsection: 12
105	105	‘‘(A) The term ‘covered item’ means— 13
106	106	‘‘(i) non-stick cookware or food service 14
107	107	ware for use in galleys or dining facilities; 15
108	108	‘‘(ii) food packaging materials; 16
109	109	‘‘(iii) cleaning products, including 17
110	110	floor waxes; 18
111	111	‘‘(iv) carpeting; 19
112	112	‘‘(v) rugs, curtains, or upholstered 20
113	113	furniture; 21
114	114	‘‘(vi) sunscreen; 22
115	115	‘‘(vii) shoes and clothing for which 23
116	116	treatment with a perfluoroalkyl substance 24

122	122	‘‘(viii) such other items as may be de-3
123	123	termined by the Secretary. 4
124	124	‘‘(B) The term ‘perfluoroalkyl substance’ 5
125	125	means a man-made chemical of which all of the 6
126	126	carbon atoms are fully fluorinated carbon 7
127	127	atoms. 8
128	128	‘‘(C) The term ‘polyfluoroalkyl substance’ 9
129	129	means a man-made chemical containing at least 10
130	130	one fully fluorinated carbon atom and at least 11
131	131	one nonfluorinated carbon atom.’’. 12

135	135	EPORTS.—Not later than 270 days after 14
136	136	the date of the enactment of this Act, and annually 15
137	137	thereafter, the Secretary of Defense shall submit to 16
138	138	the Committees on Armed Services of the House of 17
139	139	Representatives and the Senate a report containing 18
140	140	a detailed description of the following: 19
141	141	(A) Steps taken to identify covered items 20
142	142	acquired by the Secretary of Defense that con-21
143	143	tain or are produced using perfluoroalkyl sub-22
144	144	stances or polyfluoroalkyl substances. 23
145	145	(B) Steps taken to limit the acquisition by 24
146	146	the Secretary of covered items that contain or 25

158	158	terms ‘‘covered item’’, ‘‘perfluoroalkyl substance’’, 8
159	159	and ‘‘polyfluoroalkyl substance’’ have the meanings 9
160	160	given those terms in section 333(b) of the National 10
161	161	Defense Authorization Act for Fiscal Year 2021 11
