50	50	tives of the United States of America in Congress assembled, 2
51	51	SECTION 1. SHORT TITLE. 3
52	52	This Act may be cited as the ‘‘Firearm Industry Non- 4
53	53	Discrimination Act’’ or the ‘‘FIND Act’’. 5
54	54	SEC. 2. PROHIBITION ON ENTERING INTO CONTRACTS 6
55	55	WITH ENTITIES DISCRIMINATING AGAINST 7
56	56	FIREARM OR AMMUNITION INDUSTRIES. 8
57	57	(a) P
58	58	ROHIBITION.—Chapter 47 of title 41, United 9
59	59	States Code, is amended by adding at the end the fol-10
60	60	lowing: 11
61	61	‘‘§ 4715. Prohibition on entering into contracts with 12
62	62	entities discriminating against firearm or 13
63	63	ammunition industries. 14
64	64	‘‘(a) P
65	65	ROHIBITION.— 15
66	66	‘‘(1) I
67	67	N GENERAL.—The head of an executive 16
68	68	agency shall include in each contract for the pro-17
69	69	curement of goods or services awarded by the execu-18
70	70	tive agency, a clause requiring the prime contractor 19
71	71	to certify that the contractor— 20
72	72	‘‘(A) has no policy, practice, guidance, or 21
73	73	directive that discriminates against a firearm 22
74	74	entity or firearm trade association; and 23
75	75	‘‘(B) will not adopt a policy, practice, guid-24
76	76	ance, or directive that discriminates against a 25

82	82	‘‘(2) S
83	83	UBCONTRACTS.—The head of an execu-3
84	84	tive agency shall include in each contract for the 4
85	85	procurement of goods or services awarded by the ex-5
86	86	ecutive agency, a clause that prohibits the prime 6
87	87	contractor on such contract from— 7
88	88	‘‘(A) awarding a first-tier subcontract with 8
89	89	a value greater than 10 percent of the total 9
90	90	value of the prime contract to an entity that 10
91	91	fails to certify in writing to the prime con-11
92	92	tractor that the entity— 12
93	93	‘‘(i) has no policy, practice, guidance, 13
94	94	or directive that discriminates against a 14
95	95	firearm entity or firearm trade association; 15
96	96	and 16
97	97	‘‘(ii) will not adopt a policy, practice, 17
98	98	guidance, or directive that discriminates 18
99	99	against a firearm entity or firearm trade 19
100	100	association during the term of the con-20
101	101	tract; and 21
102	102	‘‘(B) structuring subcontract tiers in a 22
103	103	manner designed to avoid violating subpara-23
104	104	graph (A) by enabling a subcontractor to per-24
105	105	form more than 10 percent of the total value of 25

112	112	ENALTIES.—The clause included in con-3
113	113	tracts pursuant to paragraph (1) or paragraph (2) 4
114	114	shall provide that, in the event that the prime con-5
115	115	tractor violates the clause— 6
116	116	‘‘(A) the prime contract shall be termi-7
117	117	nated for default; and 8
118	118	‘‘(B) a suspension or debarment pro-9
119	119	ceeding will be initiated for the contractor on 10
120	120	the basis of the violation. 11
121	121	‘‘(b) E
122	122	XCEPTION.—Subsection (a) shall not apply to 12
123	123	a contract for the procurement of goods or services that 13
124	124	is a sole-source contract. 14
125	125	‘‘(c) D
126	126	EFINITIONS.—In this section: 15
127	127	‘‘(1) D
128	128	ISCRIMINATE.—The term ‘discriminate’ 16
129	129	means to— 17
130	130	‘‘(A) make a judgement about a policy, 18
131	131	practice, guidance, or directive on the basis 19
132	132	of— 20
133	133	‘‘(i) partial criteria or a category- 21
134	134	based assessment analysis, rather than— 22
135	135	‘‘(I) on a case-by-case basis; or 23
136	136	‘‘(II) using empirical data evalu-24
137	137	ated under quantifiable standards; or 25

145	145	ty or trade association or the products 5
146	146	or services sold by the firearm entity 6
147	147	or trade association; or 7
148	148	‘‘(II) favoritism for market alter-8
149	149	natives to the business of the firearm 9
150	150	entity or the trade association; 10
151	151	‘‘(B) refuse to provide services, or deny, 11
152	152	cancel, or limit services, to the firearm entity or 12
153	153	trade association on the basis of criteria other 13
154	154	than— 14
155	155	‘‘(i) criteria free from— 15
156	156	‘‘(I) favoritism or prejudice 16
157	157	against or dislike for the firearm enti-17
158	158	ty or trade association or the products 18
159	159	or services sold by the firearm entity 19
160	160	or trade association; or 20
161	161	‘‘(II) favoritism for market alter-21
162	162	natives to the business of the firearm 22
163	163	entity or the trade association; 23

168	168	and financial risk specific to a customer or 2
169	169	potential customer; or 3
170	170	‘‘(iii) criteria related to noncompliance 4
171	171	with Federal, State, or local law; or 5
172	172	‘‘(C) limit the operations of the firearm en-6
173	173	tity or trade association in manner not required 7
174	174	by— 8
175	175	‘‘(i) Federal, State, or local law; or 9
176	176	‘‘(ii) Federal, State, or local regula-10
177	177	tion. 11
178	178	‘‘(2) F
179	179	IREARM ENTITY.—The term ‘firearm en-12
180	180	tity’ means any— 13
181	181	‘‘(A) person who is licensed under section 14
182	182	923 of title 18 to import, manufacture, or deal 15
183	183	in firearms; 16
184	184	‘‘(B) seller of ammunition, as defined in 17
185	185	section 7903 of title 15; 18
186	186	‘‘(C) manufacturer or importer of, or deal-19
187	187	er in, a secure gun storage or safety device, as 20
188	188	defined in section 921(a) of title 18; and 21
189	189	‘‘(D) manufacturer or importer of, or deal-22
190	190	er in, a component part or accessory of a fire-23
191	191	arm or ammunition. 24

195	195	‘‘(3) FIREARM TRADE ASSOCIATION .—The term 1
196	196	‘firearm trade association’ has the meaning in sec-2
197	197	tion 7903 of title 15. 3

199	199	IRST-TIER SUBCONTRACT .—The term 4
200	200	‘first-tier subcontract’ means a subcontract entered 5
201	201	into by a subcontractor with the prime contractor 6
202	202	for the purposes of carrying out the prime contract. 7

204	204	OWER-TIER SUBCONTRACTOR .—The term 8
205	205	‘lower-tier subcontractor’ means any person entering 9
206	206	into a contract with a subcontractor of a prime con-10
207	207	tractor for the purposes of carrying out the prime 11
208	208	contract. 12
209	209	‘‘(6) P
210	210	RIME CONTRACT; PRIME CONTRACTOR .— 13
211	211	The terms ‘prime contract’ and ‘prime contractor’ 14
212	212	have the meaning given those terms in section 8701 15
213	213	of title 41.’’. 16
214	214	(b) A
215	215	PPLICATION.—Section 4715 of title 41, United 17
216	216	States Code, as added by subsection (a), shall apply with 18
217	217	respect to contracts awarded on or after the date of the 19
218	218	enactment of this Act. 20
219	219	(c) C
220	220	LERICALAMENDMENT.—The table of sections 21
221	221	for chapter 47 of title 41, United States Code, is amended 22
222	222	by adding at the end the following: 23
223	223	‘‘4715. Prohibition on entering into contracts with entities discriminating
224	224	against firearm or ammunition industries.’’.
