To amend title 18, United States Code, to provide an alter-
nate release date for certain nonviolent offenders, and
for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Federal Prison Bureau 4
Nonviolent Offender Relief Act of 2023’’. 5
SEC. 2. EARLY RELEASE FOR CERTAIN NONVIOLENT OF-6
FENDERS. 7
(a) I
NGENERAL.—Section 3624 of title 18, United 8
States Code, is amended— 9

(1) in subsection (a), by inserting ‘‘on the early 1
release date determined in accordance with sub-2
section (h), if applicable, or otherwise’’ after ‘‘A 3
prisoner shall be released by the Bureau of Prisons’’; 4
and 5
(2) by adding at the end the following: 6
‘‘(h) E
ARLYRELEASE FORCERTAINNONVIOLENT 7
O
FFENDERS.—Notwithstanding any other provision of 8
law, the Bureau of Prisons, pursuant to any policy for 9
early release based on the prisoner’s conduct while incar-10
cerated, shall release from confinement a prisoner who has 11
served one half or more of their term of imprisonment (in-12
cluding any consecutive term or terms of imprisonment) 13
if that prisoner— 14
‘‘(1) has attained the age of 45 years; 15
‘‘(2) has never been convicted of a crime of vio-16
lence; and 17
‘‘(3) has not engaged in any violation of institu-18
tional disciplinary regulations involving violent con-19
duct.’’. 20
