To amend the Immigration and Nationality Act to establish
certain family separation as an exceptional and extremely
unusual hardship, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Grant Relief for Amer-4
ican Children’s Elevation Act of 2023’’ or the ‘‘GRACE 5
Act’’. 6

Section 240A(b) of the Immigration and Nationality 3
Act (8 U.S.C. 1229b) is amended by adding at the end 4
the following: 5
‘‘(7) E
XCEPTIONAL AND EXTREMELY UNUSUAL 6
HARDSHIP DEFINED .—In this subsection, the term 7
‘exceptional and extremely unusual hardship’ shall 8
include hardship resulting from separating a family 9
member who is a United States citizen, a lawful per-10
manent resident or an individual lawfully admitted 11
to the United States and a family member who is 12
subject to deportation or removal from the United 13
States.’’. 14
