2424 SECTION 1. SHORT TITLE. 3
2525 This Act may be cited as the ‘‘Woman’s Right To 4
2626 Know Act’’. 5
2727 SEC. 2. REQUIREMENT OF INFORMED CONSENT. 6

3333 (1) REQUIREMENT OF COMPLIANCE BY PRO -1
3434 VIDERS.—Any abortion provider, acting in or affect-2
3535 ing interstate or foreign commerce, who knowingly 3
3636 performs, or attempts to perform, any abortion shall 4
3737 comply with the requirements of this section. 5

3939 EVIEW OF MEDICAL RISKS AND UNBORN 6
4040 HEALTH STATUS.—An abortion provider who intends 7
4141 to perform, or attempt to perform, an abortion may 8
4242 not perform any part of the abortion procedure with-9
4343 out first— 10
4444 (A) performing an ultra sound on the 11
4545 woman seeking the abortion and sharing the re-12
4646 sults of such ultra sound with the woman; and 13
4747 (B) obtaining a signed Informed Consent 14
4848 Authorization form in accordance with this sub-15
4949 section. 16

5151 NFORMED CONSENT AUTHORIZATION 17
5252 FORM.— 18
5353 (A) I
5454 N GENERAL.—The Informed Consent 19
5555 Authorization form required under this sub-20
5656 section shall— 21
5757 (i) be presented in person by the abor-22
5858 tion provider 24 hours prior to performing, 23
5959 or attempting to perform, the abortion to 24
6060 the woman seeking the abortion; and 25

6565 (I) a statement by the abortion 2
6666 provider indicating— 3
6767 (aa) the probable gestational 4
6868 age, in completed days, of the 5
6969 child; 6
7070 (bb) all medical risks associ-7
7171 ated with the specific abortion 8
7272 procedure; and 9
7373 (cc) the major developmental 10
7474 characteristics of unborn children 11
7575 at such gestational age, including 12
7676 the presence of a heartbeat, the 13
7777 ability to react to painful stimuli, 14
7878 and the development of organs, 15
7979 appendages, and facial features; 16
8080 (II) a statement by the abortion 17
8181 provider that an ultra sound has been 18
8282 performed, and the results of such 19
8383 ultra sound have been shared, as re-20
8484 quired by paragraph (2)(A); 21
8585 (III) a statement that the re-22
8686 quirements of this subsection are 23
8787 binding upon the abortion provider 24
8888 and all other medical personnel, that 25

9292 such abortion providers and medical 1
9393 personnel are subject to criminal and 2
9494 civil penalties for violations of these 3
9595 requirements, and that a woman on 4
9696 whom an abortion has been performed 5
9797 may take civil action if these require-6
9898 ments are not followed; and 7
9999 (IV) an affirmation that each in-8
100100 dividual signing the Informed Consent 9
101101 Authorization form has filled out the 10
102102 form to the best of his or her knowl-11
103103 edge and understands the information 12
104104 contained in the form. 13

106106 IGNATORIES REQUIRED .—The In-14
107107 formed Consent Authorization form required 15
108108 under this subsection shall be signed in person 16
109109 by the woman seeking the abortion, the abor-17
110110 tion provider performing or attempting to per-18
111111 form the abortion, and a witness. 19

113113 ETENTION OF CONSENT FORM .—The 20
114114 abortion provider performing or attempting to 21
115115 perform an abortion shall retain the signed In-22
116116 formed Consent Authorization form required 23
117117 under this subsection in the patient’s medical 24
118118 file. 25

123123 TION.—Paragraph (j)(2) of section 164.530 of 2
124124 title 45, Code of Federal Regulations, shall 3
125125 apply to the Informed Consent Authorization 4
126126 form required to be placed in a patient’s med-5
127127 ical file pursuant to subparagraph (C) in the 6
128128 same manner and to the same extent as such 7
129129 paragraph applies to documentation required by 8
130130 paragraph (j)(1) of such section. 9
131131 (4) E
132132 XCEPTIONS.—The requirements of this 10
133133 subsection shall not apply if, in reasonable medical 11
134134 judgment, compliance with paragraph (2) would pose 12
135135 a greater risk of— 13
136136 (A) the death of the pregnant woman; or 14
137137 (B) the substantial and irreversible phys-15
138138 ical impairment of a major bodily function, not 16
139139 including psychological or emotional conditions, 17
140140 of the pregnant woman. 18

146146 NFORCEMENT BY ATTORNEY GEN -21
147147 ERAL.—The Attorney General shall commence 22
148148 a civil action in an appropriate district court of 23
149149 the United States under this subsection against 24

153153 any abortion provider who knowingly commits a 1
154154 violation of subsection (a). 2
155155 (B) P
156156 ENALTY.—In a civil action under 3
157157 subparagraph (A), the court may, to vindicate 4
158158 the public interest, assess a civil penalty against 5
159159 the abortion provider in an amount— 6
160160 (i) not less than $100,000 and not 7
161161 more than $150,000, for each such viola-8
162162 tion that is adjudicated in the first pro-9
163163 ceeding against such abortion provider 10
164164 under this subsection; or 11
165165 (ii) not less than $150,001 and not 12
166166 more than $250,000, for each such viola-13
167167 tion that is adjudicated in a subsequent 14
168168 proceeding against such abortion provider 15
169169 under this subsection. 16

171171 OTIFICATION.—Upon the assessment 17
172172 of a civil penalty under subparagraph (B), the 18
173173 Attorney General shall notify the appropriate 19
174174 State medical licensing authority. 20

176176 O PENALTIES FOR PREGNANT 21
177177 WOMEN.—A pregnant woman shall not be sub-22
178178 ject to any penalty under this section. 23

180180 RIVATE RIGHT OF ACTION.— 24

184184 (A) IN GENERAL.—A woman or a parent 1
185185 of a minor upon whom an abortion has been 2
186186 performed in violation of subsection (a) may 3
187187 commence a civil action against the abortion 4
188188 provider for appropriate relief. 5
189189 (B) A
190190 PPROPRIATE RELIEF .—Appropriate 6
191191 relief in a civil action under this paragraph in-7
192192 cludes— 8
193193 (i) objectively verifiable money dam-9
194194 ages for all injuries, psychological and 10
195195 physical, occasioned by the violation; 11
196196 (ii) statutory damages equal to 3 12
197197 times the cost of the abortion; and 13
198198 (iii) punitive damages. 14
199199 (C) A
200200 TTORNEY’S FEES FOR PLAINTIFF .— 15
201201 The court shall award a reasonable attorney’s 16
202202 fee as part of the costs to a prevailing plaintiff 17
203203 in a civil action under this paragraph. 18
204204 (D) A
205205 TTORNEY’S FEES FOR DEFEND -19
206206 ANT.—If a defendant in a civil action under 20
207207 this paragraph prevails and the court finds that 21
208208 the plaintiff’s suit was frivolous, the court shall 22
209209 award a reasonable attorney’s fee in favor of 23
210210 the defendant against the plaintiff. 24

214214 (E) AWARDS AGAINST WOMAN .—In any 1
215215 civil action under this paragraph, no damages 2
216216 or other monetary relief, and no attorney’s fees 3
217217 except as provided under subparagraph (D), 4
218218 may be assessed against the woman upon whom 5
219219 the abortion was performed or attempted. 6

221221 REEMPTION.—Nothing in this Act or the amend-7
222222 ments made by this Act shall be construed to preempt any 8
223223 provision of State law to the extent that such State law 9
224224 establishes, implements, or continues in effect disclosure 10
225225 requirements regarding abortion or penalties for failure to 11
226226 comply with such requirements that are more extensive 12
227227 than those provided under the amendment made by this 13
228228 Act. 14
229229 (d) R
230230 ULE OFCONSTRUCTION.—Nothing in this Act 15
231231 shall be construed to prohibit an abortion provider from 16
232232 presenting the information required under subsection (a) 17
233233 to a pregnant woman at the same time as acquiring in-18
234234 formed consent for an abortion from such woman in ac-19
235235 cordance with State law, provided that the presentation 20
236236 of such information occurs at least 24 hours before the 21
237237 abortion. 22

239239 EFINITIONS.—In this section: 23

243243 (1) ABORTION.—The term ‘‘abortion’’ means 1
244244 the use or prescription of any instrument, medicine, 2
245245 drug, or any other substance or device— 3
246246 (A) to intentionally kill the unborn child of 4
247247 a woman known to be pregnant; or 5
248248 (B) to intentionally terminate the preg-6
249249 nancy of a woman known to be pregnant, with 7
250250 an intention other than— 8
251251 (i) after viability to produce a live 9
252252 birth and preserve the life and health of 10
253253 the child born alive; or 11
254254 (ii) to remove a dead unborn child. 12
255255 (2) A
256256 BORTION PROVIDER.—The term ‘‘abortion 13
257257 provider’’ means a person— 14
258258 (A) licensed to practice medicine and sur-15
259259 gery or osteopathic medicine and surgery; or 16
260260 (B) otherwise legally authorized to perform 17
261261 an abortion. 18
262262 (3) A
263263 TTEMPT.—The term ‘‘attempt’’, with re-19
264264 spect to an abortion, means conduct that, under the 20
265265 circumstances as the actor believes them to be, con-21
266266 stitutes a substantial step in a course of conduct 22
267267 planned to culminate in performing an abortion. 23

269269 INOR.—The term ‘‘minor’’ means an indi-24
270270 vidual who has not attained the age of 18 years. 25

274274 (5) PERFORM.—The term ‘‘perform’’, with re-1
275275 spect to an abortion, includes inducing an abortion 2
276276 through a medical or chemical intervention including 3
277277 writing a prescription for a drug or device intended 4
278278 to result in an abortion. 5

280280 EASONABLE MEDICAL JUDGMENT .—The 6
281281 term ‘‘reasonable medical judgment’’ means a med-7
282282 ical judgment that would be made by a reasonably 8
283283 prudent abortion provider, knowledgeable about the 9
284284 case and the treatment possibilities with respect to 10
285285 the medical conditions involved. 11
286286 (7) U
287287 NBORN CHILD.—The term ‘‘unborn child’’ 12
288288 means an individual organism of the species homo 13
289289 sapiens, beginning at fertilization, until the point of 14
290290 being born alive as defined in section 8(b) of title 1, 15
291291 United States Code. 16
292292 (8) W
293293 OMAN.—The term ‘‘woman’’ means a fe-17
294294 male human being whether or not she has reached 18
295295 the age of majority. 19
