16	16	a State plan option under the Medicaid program, and
17	17	for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. CERTIFIED COMMUNITY BEHAVIORAL HEALTH 3
21	21	CLINIC SERVICES UNDER MEDICAID. 4
22	22	(a) D
23	23	EFINITION OFMEDICALASSISTANCE.—Section 5
24	24	1905 of the Social Security Act (42 U.S.C. 1396d) is 6
25	25	amended— 7
26	26	(1) in subsection (a)— 8

42	42	ERTIFIEDCOMMUNITYBEHAVIORALHEALTH 12

44	44	LINICSERVICES.— 13
45	45	‘‘(1) I
46	46	N GENERAL.—The term ‘certified commu-14
47	47	nity behavioral health services’ means any of the fol-15
48	48	lowing services when furnished to an individual as a 16
49	49	patient of a certified community behavioral health 17
50	50	clinic (as defined in paragraph (2)), in a manner re-18
51	51	flecting person-centered care and which, if not avail-19
52	52	able directly through a certified community behav-20
53	53	ioral health clinic, may be provided or referred 21
54	54	through formal relationships with other providers: 22
55	55	‘‘(A) Crisis mental health services, includ-23
56	56	ing 24-hour mobile crisis teams, emergency cri-24
57	57	sis intervention services, and crisis stabilization. 25

61	61	‘‘(B) Screening, assessment, and diagnosis, 1
62	62	including risk assessment. 2
63	63	‘‘(C) Patient-centered treatment planning 3
64	64	or similar processes, including risk assessment 4
65	65	and crisis planning. 5
66	66	‘‘(D) Outpatient mental health and sub-6
67	67	stance use services. 7
68	68	‘‘(E) Outpatient clinic primary care screen-8
69	69	ing and monitoring of key health indicators and 9
70	70	health risk. 10
71	71	‘‘(F) Intensive case management services. 11
72	72	‘‘(G) Psychiatric rehabilitation services. 12
73	73	‘‘(H) Peer support and counselor services 13
74	74	and family supports. 14
75	75	‘‘(I) Intensive, community-based mental 15
76	76	health care for members of the Armed Forces 16
77	77	and veterans who are eligible for medical assist-17
78	78	ance, particularly such members and veterans 18
79	79	located in rural areas, provided the care is con-19
80	80	sistent with minimum clinical mental health 20
81	81	guidelines promulgated by the Veterans Health 21
82	82	Administration, including clinical guidelines 22
83	83	contained in the Uniform Mental Health Serv-23
84	84	ices Handbook of such Administration. 24

88	88	‘‘(2) CERTIFIED COMMUNITY BEHAVIORAL 1
89	89	HEALTH CLINIC.—The term ‘certified community be-2
90	90	havioral health clinic’ means an organization that— 3
91	91	‘‘(A) has been certified by a State as meet-4
92	92	ing the criteria established by the Secretary 5
93	93	pursuant to subsection (a) of section 223 of the 6
94	94	Protecting Access to Medicare Act as of Janu-7
95	95	ary 1, 2024, and any subsequent updates to 8
96	96	such criteria, regardless of whether the State is 9
97	97	carrying out a demonstration program under 10
98	98	this title under subsection (d) of such section; 11
99	99	‘‘(B) is engaged in furnishing all of the 12
100	100	services described in paragraph (1); and 13
101	101	‘‘(C) agrees, as a condition of the certifi-14
102	102	cation described in subparagraph (A), to fur-15
103	103	nish to the State or Secretary any data re-16
104	104	quired as part of ongoing monitoring of the or-17
105	105	ganization’s provision of services, including en-18
106	106	counter data, clinical outcomes data, quality 19
107	107	data, and such other data as the State or Sec-20
108	108	retary may require.’’. 21

110	110	FFECTIVEDATE.—The amendments made by 22
111	111	this section shall apply with respect to medical assistance 23
112	112	furnished on or after the date of enactment of this Act. 24
