Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. CERTIFIED COMMUNITY BEHAVIORAL HEALTH 3 CLINIC SERVICES UNDER MEDICAID. 4 (a) D EFINITION OFMEDICALASSISTANCE.—Section 5 1905 of the Social Security Act (42 U.S.C. 1396d) is 6 amended— 7 (1) in subsection (a)— 8 VerDate Sep 11 2014 00:39 Mar 09, 2024 Jkt 049200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H7545.IH H7545 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •HR 7545 IH (A) in paragraph (30), by striking ‘‘; and’’ 1 and inserting a semicolon; 2 (B) by redesignating paragraph (31) as 3 paragraph (32); and 4 (C) by inserting after paragraph (30) the 5 following new paragraph: 6 ‘‘(31) certified community behavioral health 7 clinic services, as defined in subsection (jj); and’’; 8 and 9 (2) by adding at the end the following new sub-10 section: 11 ‘‘(jj) C ERTIFIEDCOMMUNITYBEHAVIORALHEALTH 12 C LINICSERVICES.— 13 ‘‘(1) I N GENERAL.—The term ‘certified commu-14 nity behavioral health services’ means any of the fol-15 lowing services when furnished to an individual as a 16 patient of a certified community behavioral health 17 clinic (as defined in paragraph (2)), in a manner re-18 flecting person-centered care and which, if not avail-19 able directly through a certified community behav-20 ioral health clinic, may be provided or referred 21 through formal relationships with other providers: 22 ‘‘(A) Crisis mental health services, includ-23 ing 24-hour mobile crisis teams, emergency cri-24 sis intervention services, and crisis stabilization. 25 VerDate Sep 11 2014 00:39 Mar 09, 2024 Jkt 049200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H7545.IH H7545 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 7545 IH ‘‘(B) Screening, assessment, and diagnosis, 1 including risk assessment. 2 ‘‘(C) Patient-centered treatment planning 3 or similar processes, including risk assessment 4 and crisis planning. 5 ‘‘(D) Outpatient mental health and sub-6 stance use services. 7 ‘‘(E) Outpatient clinic primary care screen-8 ing and monitoring of key health indicators and 9 health risk. 10 ‘‘(F) Intensive case management services. 11 ‘‘(G) Psychiatric rehabilitation services. 12 ‘‘(H) Peer support and counselor services 13 and family supports. 14 ‘‘(I) Intensive, community-based mental 15 health care for members of the Armed Forces 16 and veterans who are eligible for medical assist-17 ance, particularly such members and veterans 18 located in rural areas, provided the care is con-19 sistent with minimum clinical mental health 20 guidelines promulgated by the Veterans Health 21 Administration, including clinical guidelines 22 contained in the Uniform Mental Health Serv-23 ices Handbook of such Administration. 24 VerDate Sep 11 2014 01:47 Mar 12, 2024 Jkt 049200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H7545.IH H7545 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 7545 IH ‘‘(2) CERTIFIED COMMUNITY BEHAVIORAL 1 HEALTH CLINIC.—The term ‘certified community be-2 havioral health clinic’ means an organization that— 3 ‘‘(A) has been certified by a State as meet-4 ing the criteria established by the Secretary 5 pursuant to subsection (a) of section 223 of the 6 Protecting Access to Medicare Act as of Janu-7 ary 1, 2024, and any subsequent updates to 8 such criteria, regardless of whether the State is 9 carrying out a demonstration program under 10 this title under subsection (d) of such section; 11 ‘‘(B) is engaged in furnishing all of the 12 services described in paragraph (1); and 13 ‘‘(C) agrees, as a condition of the certifi-14 cation described in subparagraph (A), to fur-15 nish to the State or Secretary any data re-16 quired as part of ongoing monitoring of the or-17 ganization’s provision of services, including en-18 counter data, clinical outcomes data, quality 19 data, and such other data as the State or Sec-20 retary may require.’’. 21 (b) E FFECTIVEDATE.—The amendments made by 22 this section shall apply with respect to medical assistance 23 furnished on or after the date of enactment of this Act. 24 Æ VerDate Sep 11 2014 00:39 Mar 09, 2024 Jkt 049200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H7545.IH H7545 kjohnson on DSK7ZCZBW3PROD with $$_JOB
