364364 EC. 101. (a) Upon the determination of the Sec-3
365365 retary of Defense that such action is necessary in the na-4
366366 tional interest, the Secretary may, with the approval of 5
367367 the Director of the Office of Management and Budget, 6
368368 transfer up to $1,000,000,000 only between the appro-7
369369 priations or funds made available in this title to the De-8
370370 partment of Defense to respond to the situation in 9
371371 Ukraine and for related expenses: Provided, That the Sec-10
372372 retary shall notify the Congress promptly of each transfer 11
373373 made pursuant to the authority in this subsection: Pro-12
374374 vided further, That such authority is in addition to any 13
375375 transfer authority otherwise provided by law and is subject 14
376376 to the same terms and conditions as the authority pro-15
377377 vided in section 8005 of the Department of Defense Ap-16
378378 propriations Act, 2024 (division A of Public Law 118–47), 17
379379 except for monetary limitations concerning the amount of 18
380380 authority available. 19
381381 (b) Upon the determination by the Director of Na-20
382382 tional Intelligence that such action is necessary in the na-21
383383 tional interest, the Director may, with the approval of the 22
384384 Director of the Office of Management and Budget, trans-23
385385 fer up to $250,000,000 only between the appropriations 24
386386 or funds made available in this title for the National Intel-25

401401 EC. 102. Not later than 60 days after the date of 11
402402 enactment of this Act, the Secretary of Defense, in coordi-12
403403 nation with the Secretary of State, shall submit a report 13
404404 to the Committees on Appropriations, Armed Services, 14
405405 and Foreign Affairs of the House of Representatives and 15
406406 the Committees on Appropriations, Armed Services, and 16
407407 Foreign Relations of the Senate on measures being taken 17
408408 to account for United States defense articles designated 18
409409 for Ukraine since the February 24, 2022, Russian inva-19
410410 sion of Ukraine, particularly measures with regard to such 20
411411 articles that require enhanced end-use monitoring; meas-21
412412 ures to ensure that such articles reach their intended re-22
413413 cipients and are used for their intended purposes; and any 23
414414 other measures to promote accountability for the use of 24
415415 such articles: Provided, That such report shall include a 25

994994 contributions to the Government of Ukraine may not ex-23

10141014 tributions and an update on the status of such contribu-15
10151015 tions: Provided further, That the requirements of this sub-16
10161016 section shall continue in effect until such funds are ex-17
