Us Congress Senate Bill SB1

Introduced
7/25/23

Caption

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. The bill declares that the right of a U.S. citizen to vote in any election for federal office shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. The bill establishes certain federal criminal offenses related to voting. In particular, the bill establishes a new criminal offense for conduct (or attempted conduct) to corruptly hinder, interfere with, or prevent another person from registering to vote or helping someone register to vote. Additionally, the bill sets forth provisions related to election security, including by requiring states to conduct post-election audits for federal elections. The bill outlines criteria for congressional redistricting and generally prohibits mid-decade redistricting. The bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosure of campaign-related fundraising and spending, requiring additional disclaimers regarding certain political advertising, and establishing an alternative campaign funding system for certain federal offices.

Impact

If enacted, SB1 would significantly impact existing state laws regarding elections and voting. The bill introduces federal standards for voting procedures, which state governments would need to comply with. This includes requirements for conducting post-election audits for verification of results, thus enhancing public confidence in the integrity of elections. The legislation also aims to enhance voter protection by penalizing actions intended to obstruct voter registration or voting, which could reshape how states enforce voter control measures.

Summary

SB1, also known as the Freedom to Vote Act, is a comprehensive piece of legislation aimed at enhancing voting access, improving election security, and addressing the influence of money in politics. The bill proposes measures such as automatic and same-day voter registration, expands access to early and mail-in voting, and mandates that Election Day be recognized as a federal holiday. It also includes provisions to limit voter roll purges, thereby ensuring that eligible voters retain their right to vote even if they have changed addresses or missed previous elections.

Contention

Notably, SB1 has sparked discussion and contention among legislators. Supporters, primarily from the Democratic Party, argue that the bill is essential for safeguarding democracy and ensuring equitable access to the electoral process. However, critics, mainly from the Republican Party, claim that the bill represents federal overreach and may undermine the integrity of elections by facilitating potential voter fraud. They argue that the changes to registration and voting processes could complicate state election administration and lead to increased scrutiny of election outcomes.
