STATEMENT OF POLICY. 24 It is the policy of the United States— 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00016 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 17 •S 1829 RS (1) to deny the Islamic Republic of Iran the abil-1 ity to engage in destabilizing activities, support inter-2 national terrorism, fund the development and acquisi-3 tion of weapons of mass destruction and the means to 4 deliver such weapons by limiting export of petroleum 5 and petroleum products by the Islamic Republic of 6 Iran; 7 (2) to deny the Islamic Republic of Iran funds 8 to oppress and commit human rights violations 9 against the Iranian people who are assembling peace-10 fully to redress the Iranian regime; 11 (3) to sanction entities that provide support to 12 the Iranian energy sector; and 13 (4) to counter the efforts of the Islamic Republic 14 of Iran to finance and facilitate the participation of 15 foreign terrorist organizations in ongoing conflicts 16 and illicit activities in the region and beyond, which 17 is detrimental to the national security interests of the 18 United States. 19 SEC. 4. SANCTIONS WITH RESPECT TO FOREIGN PERSONS 20 THAT ENGAGE IN CERTAIN TRANSACTIONS. 21 (a) I MPOSITION OFSANCTIONS.— 22 (1) I N GENERAL.—On and after the date that is 23 180 days after the date of the enactment of this Act, 24 the President shall impose the sanctions described in 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 18 •S 1829 RS subsection (b) with respect to a foreign person that the 1 President determines knowingly engaged, on or after 2 such date of enactment, in an activity described in 3 paragraph (2). 4 (2) A CTIVITIES DESCRIBED.—A foreign person 5 engages in an activity described in this paragraph if 6 the foreign person— 7 (A) owns or operates a foreign port at 8 which, on or after the date of the enactment of 9 this Act, such person knowingly permits to dock 10 a vessel— 11 (i) that is included on the list of spe-12 cially designated nationals and blocked per-13 sons maintained by the Office of Foreign 14 Assets Control of the Department of the 15 Treasury for transporting Iranian crude oil 16 or petroleum products; or 17 (ii) of which the operator or owner of 18 such vessel otherwise knowingly engages in 19 a significant transaction involving such ves-20 sel to transport, offload, or deal in signifi-21 cant transactions in condensate, refined, or 22 unrefined petroleum products, or other pe-23 trochemical products originating from the 24 Islamic Republic of Iran; 5 (C) owns or operates a vessel that is know-6 ingly used by a foreign person for the transpor-7 tation of significant amounts of petroleum or pe-8 troleum products from the Islamic Republic of 9 Iran; 10 (D) owns or operates a refinery through 11 which such owner knowingly engages in a sig-12 nificant transaction to process, refine, or other-13 wise deal in any petroleum product originating 14 from the Islamic Republic of Iran; 15 (E) is a covered family member of a foreign 16 person described in subparagraph (A), (B), or 17 (D); or 18 (F) is owned or controlled by a foreign per-19 son described in subparagraph (A), (B), or (D), 20 and knowingly engages in an activity described 21 in subparagraph (A), (B), or (D). 22 (b) S ANCTIONSDESCRIBED.—The sanctions described 23 in this subsection are the following: 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00019 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 20 •S 1829 RS (1) SANCTIONS ON FOREIGN VESSELS .—Subject 1 to such regulations as the President may prescribe, 2 the President may prohibit a vessel described in sub-3 section (a)(2)(A) or (a)(2)(B) from landing at any 4 port in the United States— 5 (A) with respect to a vessel described in sub-6 section (a)(2)(A), for a period of not more than 7 2 years beginning on the date on which the 8 President imposes sanctions with respect to a re-9 lated foreign port described in subsection 10 (a)(2)(A); and 11 (B) with respect to a vessel described in sub-12 section (a)(2)(B), for a period of not more than 13 2 years. 14 (2) P ROPERTY BLOCKING.—The President shall 15 exercise all of the powers granted to the President 16 under the International Emergency Economic Powers 17 Act (50 U.S.C. 1701 et seq.) to the extent necessary 18 to block and prohibit all transactions in property and 19 interests in property of the foreign person if such 20 property and interests in property are in the United 21 States, come within the United States, or are or come 22 within the possession or control of a United States 23 person. 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00020 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 21 •S 1829 RS (3) INELIGIBILITY FOR VISAS, ADMISSION, OR PA-1 ROLE.— 2 (A) V ISAS, ADMISSION, OR PAROLE.—In the 3 case of an alien, the alien is— 4 (i) inadmissible to the United States; 5 (ii) ineligible to receive a visa or other 6 documentation to enter the United States; 7 and 8 (iii) otherwise ineligible to be admitted 9 or paroled into the United States or to re-10 ceive any other benefit under the Immigra-11 tion and Nationality Act (8 U.S.C. 1101 et 12 seq.). 13 (B) C URRENT VISAS REVOKED.— 14 (i) I N GENERAL.—The visa or other 15 entry documentation of an alien described 16 in subparagraph (A) shall be revoked, re-17 gardless of when such visa or other entry 18 documentation was issued. 19 (ii) I MMEDIATE EFFECT .—A revoca-20 tion under clause (i) shall— 21 (I) take effect immediately; 1 and 2 (III) be implemented in accord-3 ance with section 221(i) of the Immi-4 gration and Nationality Act (8 U.S.C. 5 1201(i)). 6 (4) I MPLEMENTATION; PENALTIES.— 7 (A) I MPLEMENTATION.—The President— 8 (i) may exercise all authorities pro-9 vided under sections 203 and 205 of the 10 International Emergency Economic Powers 11 Act (50 U.S.C. 1702 and 1704) to carry out 12 this section; and 13 (ii) not later than 180 days after the 14 date of the enactment of this Act, shall pre-15 scribe such regulations as necessary to carry 16 out this Act. 17 (B) N OTIFICATION TO CONGRESS .—Not 18 later than 10 days before the effective date of any 19 regulation prescribed in accordance with sub-20 paragraph (A)(ii), the President shall brief the 21 appropriate congressional committees on the pro-22 posed regulations and the provisions of this Act 23 relating to such regulations. 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00022 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 23 •S 1829 RS (C) PENALTIES.—A person that violates, at-1 tempts to violate, conspires to violate, or causes 2 a violation of this section or any regulation, li-3 cense, or order issued to carry out this section 4 shall be subject to the penalties set forth in sub-5 sections (b) and (c) of section 206 of the Inter-6 national Emergency Economic Powers Act (50 7 U.S.C. 1705) to the same extent as a person that 8 commits an unlawful act described in subsection 9 (a) of that section. 10 (c) W AIVERS.— 11 (1) I N GENERAL.—The President may waive the 12 application of sanctions under this section for renew-13 able periods not to exceed 180 days if the President— 14 (A) determines that such a waiver is in the 15 vital national security interests of the United 16 States; and 17 (B) not less than 15 days before the grant-18 ing of the waiver, submits to the appropriate 19 congressional committees a notice of and jus-20 tification for the waiver. 21 (2) F ORM.—The waiver described in paragraph 22 (1) may be transmitted in classified form. 23 (3) S PECIAL RULE.—The President may waive 24 the application of sanctions under this section with 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00023 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 24 •S 1829 RS respect to a foreign person if the President certifies in 1 writing to the appropriate congressional committees 2 that the foreign person— 3 (A) has ceased engaging in activities de-4 scribed in subsection (a)(2); or 5 (B) has taken and is continuing to take sig-6 nificant verifiable steps toward ceasing such ac-7 tivities. 8 (d) S UNSET.—The authority to impose sanctions 9 under this section, and any sanctions imposed under this 10 section, shall terminate on the date that is 4 years after 11 the date of the enactment of this Act. 12 (e) C OVEREDFAMILYMEMBERDEFINED.—In this sec-13 tion, the term ‘‘covered family member’’, with respect to a 14 foreign person who is an individual, means a spouse, adult 15 child, parent, or sibling of the person who engages in the 16 sanctionable activity described under subsection (a)(2) or 17 who demonstrably benefits from such activity. 18 SEC. 5. REPORT ON PETROLEUM AND PETROLEUM PROD-19 UCT EXPORTS FROM IRAN. 20 (a) I NGENERAL.—Not later than 120 days after the 21 date of the enactment of this Act, the Administrator of the 22 Energy Information Administration shall submit to the ap-23 propriate congressional committees a report on the increase 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00024 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 25 •S 1829 RS of exports of petroleum and petroleum products by the Is-1 lamic Republic of Iran. 2 (b) C ONTENTS.—The report required by subsection (a) 3 shall include the following: 4 (1) An analysis of the export and sale of petro-5 leum and petroleum products by the Islamic Republic 6 of Iran since 2018, including— 7 (A) an estimate of the annual revenue of the 8 export and sale of petroleum by the Islamic Re-9 public of Iran, disaggregated by year; 10 (B) an estimate of the annual revenue of the 11 export and sale of petroleum to the People’s Re-12 public of China by the Islamic Republic of Iran, 13 disaggregated by year; 14 (C) the number of petroleum and crude oil 15 barrels annually exported by the Islamic Repub-16 lic of Iran, disaggregated by year; 17 (D) the number of petroleum and crude oil 18 barrels annually exported to the People’s Repub-19 lic of China by the Islamic Republic of Iran, 20 disaggregated by year; 21 (E) the number of petroleum and crude oil 22 barrels annually exported to countries other than 23 the People’s Republic of China by the Islamic 24 Republic of Iran, disaggregated by year; 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00025 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 26 •S 1829 RS (F) the average price per petroleum and 1 crude oil barrel annually exported by the Islamic 2 Republic of Iran, disaggregated by year; and 3 (G) the average price per petroleum and 4 crude oil barrel annually exported to the People’s 5 Republic of China by the Islamic Republic of 6 Iran, disaggregated by year. 7 (2) An analysis of the labeling practices of the 8 Islamic Republic of Iran with respect to exported pe-9 troleum and petroleum products. 10 (3) A description of persons involved in the ex-11 port and sale of petroleum and petroleum products 12 from the Islamic Republic of Iran. 13 (4) A description of vessels involved in the export 14 and sale of petroleum and petroleum products from 15 the Islamic Republic of Iran. 16 (5) A description of foreign ports involved in the 17 export and sale of petroleum and petroleum products 18 from the Islamic Republic of Iran. 19 (c) F ORM.—The report required by subsection (a) shall 20 be submitted in unclassified form, but may include a classi-21 fied annex. 22 (d) P UBLICATION.—The unclassified portion of the re-23 port required by subsection (a) shall be posted on a publicly 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00026 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 27 •S 1829 RS available website of the Energy Information Administra-1 tion. 2 SEC. 6. MODIFICATION AND EXTENSION OF SANCTIONING 3 THE USE OF CIVILIANS AS DEFENSELESS 4 SHIELDS ACT. 5 (a) I NGENERAL.—Section 3 of the Sanctioning the 6 Use of Civilians as Defenseless Shields Act (Public Law 7 115–348; 50 U.S.C. 1701 note) is amended— 8 (1) in subsection (b)— 9 (A) by redesignating paragraph (3) as 10 paragraph (4); and 11 (B) by inserting after paragraph (2) the fol-12 lowing: 13 ‘‘(3) Each foreign person that the President de-14 termines, on or after the date of the enactment of the 15 Stop Harboring Iranian Petroleum Act of 2024— 16 ‘‘(A) is a member of Palestine Islamic 17 Jihad or is knowingly acting on behalf of Pal-18 estine Islamic Jihad; and 19 ‘‘(B) knowingly orders, controls, or other-20 wise directs the use of civilians protected as such 21 by the law of war to shield military objectives 22 from attack.’’; 23 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00027 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 28 •S 1829 RS (2) by redesignating subsections (e), (f), (g), (h), 1 and (i) as subsections (f), (g), (h), (i), and (j), respec-2 tively; and 3 (3) by inserting after subsection (d) the fol-4 lowing: 5 ‘‘(e) C ONGRESSIONALREQUESTS.—Not later than 120 6 days after receiving a request from the chairman and rank-7 ing member of one of the appropriate congressional commit-8 tees with respect to whether a foreign person meets the cri-9 teria of a person described in subsection (b) or (c), the 10 President shall— 11 ‘‘(1) determine if the person meets such criteria; 12 and 13 ‘‘(2) submit a written justification to the chair-14 man and ranking member detailing whether or not 15 the President imposed or intends to impose sanctions 16 described in subsection (b) or (c) with respect to such 17 person.’’. 18 (b) D EFINITIONS.—Section 4 of the Sanctioning the 19 Use of Civilians as Defenseless Shields Act (Public Law 20 115–348; 50 U.S.C. 1701 note) is amended— 21 (1) by redesignating paragraph (7) as para-22 graph (8); and 23 (2) by inserting after paragraph (6) the fol-24 lowing: 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00028 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 29 •S 1829 RS ‘‘(7) PALESTINE ISLAMIC JIHAD .—The term 1 ‘Palestine Islamic Jihad’ means— 2 ‘‘(A) the entity known as Palestine Islamic 3 Jihad and designated by the Secretary of State 4 as a foreign terrorist organization pursuant to 5 section 219 of the Immigration and Nationality 6 Act (8 U.S.C. 1189); or 7 ‘‘(B) any person identified as an agent or 8 instrumentality of Palestine Islamic Jihad on 9 the list of specially designated nationals and 10 blocked persons maintained by the Office of For-11 eign Asset Control of the Department of the 12 Treasury, the property or interests in property of 13 which are blocked pursuant to the International 14 Emergency Economic Powers Act (50 U.S.C. 15 1701 et seq.).’’. 16 (c) S UNSET.—Section 5 of the Sanctioning the Use of 17 Civilians as Defenseless Shields Act (Public Law 115–348; 18 50 U.S.C. 1701 note) is amended by striking ‘‘December 19 31, 2023’’ and inserting ‘‘December 31, 2030’’. 20 SEC. 7. CONFRONTING ASYMMETRIC AND MALICIOUS 21 CYBER ACTIVITIES. 22 (a) I NGENERAL.—On and after the date that is 180 23 days after the date of the enactment of this Act, the Presi-24 dent may impose the sanctions described in subsection (b) 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00029 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 30 •S 1829 RS with respect to any foreign person that the President deter-1 mines, on or after such date of enactment— 2 (1) is responsible for or complicit in, or has en-3 gaged knowingly in, significant cyber-enabled activi-4 ties originating from, or directed by persons located, 5 in whole or in substantial part, outside the United 6 States that are reasonably likely to result in, or have 7 materially contributed to, a significant threat to the 8 national security, foreign policy, or economic health 9 or financial stability of the United States; 10 (2) materially assisted, sponsored, or provided fi-11 nancial, material, or technological support for, or 12 goods or services to or in support of, any activity de-13 scribed in this subsection or any person whose prop-14 erty and interests in property are blocked pursuant to 15 this section; 16 (3) is owned or controlled by, or has acted or 17 purported to act for or on behalf of, directly or indi-18 rectly, any person whose property and interests in 19 property are blocked pursuant to this section; or 20 (4) has attempted to engage in any of the activi-21 ties described in paragraph (1), (2), or (3). 22 (b) S ANCTIONSDESCRIBED.—The sanctions described 23 in this subsection are the following: 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00030 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 31 •S 1829 RS (1) INADMISSIBILITY TO UNITED STATES .—In 1 the case of an alien— 2 (A) ineligibility to receive a visa to enter 3 the United States or to be admitted to the United 4 States; or 5 (B) if the individual has been issued a visa 6 or other documentation, revocation, in accord-7 ance with section 221(i) of the Immigration and 8 Nationality Act (8 U.S.C. 1201(i)), of the visa or 9 other documentation. 10 (2) B LOCKING OF PROPERTY .—The blocking, in 11 accordance with the International Emergency Eco-12 nomic Powers Act (50 U.S.C. 1701 et seq.), of all 13 transactions in all property and interests in property 14 of a foreign person if such property and interests in 15 property are in the United States, come within the 16 United States, or are or come within the possession 17 or control of a United States person. 18 (c) R EQUESTS BY APPROPRIATECONGRESSIONAL 19 C OMMITTEES.— 20 (1) I N GENERAL.—Not later than 120 days after 21 receiving a request that meets the requirements of 22 paragraph (2) with respect to whether a foreign per-23 son has engaged in an activity described in subsection 24 (a), the President shall— 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00031 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 32 •S 1829 RS (A) determine if that person has engaged in 1 such an activity; and 2 (B) submit a classified or unclassified re-3 port to the chairperson and ranking member of 4 the committee or committees that submitted the 5 request with respect to that determination that 6 includes— 7 (i) a statement of whether or not the 8 President imposed or intends to impose 9 sanctions with respect to the person; 10 (ii) if the President imposed or intends 11 to impose sanctions, a description of those 12 sanctions; and 13 (iii) if the President does not intend to 14 impose sanctions, a description of actions 15 that meet the threshold for the President to 16 impose sanctions. 17 (2) R EQUIREMENTS.—A request under para-18 graph (1) with respect to whether a foreign person has 19 engaged in an activity described in subsection (a) 20 shall be submitted to the President in writing jointly 21 by the chairperson and ranking member of one of the 22 appropriate congressional committees. 23 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00032 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 33 •S 1829 RS SEC. 8. SANCTIONS WITH RESPECT TO THREATS TO CUR-1 RENT OR FORMER UNITED STATES OFFI-2 CIALS. 3 (a) I NGENERAL.—On and after the date that is 180 4 days after the date of the enactment of this Act, the Presi-5 dent shall impose the sanctions described in subsection (b) 6 with respect to any foreign person the President determines 7 has, on or after such date of enactment, ordered, directed, 8 or taken material steps to carry out any use of violence 9 or has attempted or threatened to use violence against any 10 current or former official of the Government of the United 11 States. 12 (b) S ANCTIONSDESCRIBED.—The sanctions described 13 in this subsection are the following: 14 (1) I NADMISSIBILITY TO UNITED STATES .—In 15 the case of a foreign person who is an individual— 16 (A) ineligibility to receive a visa to enter 17 the United States or to be admitted to the United 18 States; or 19 (B) if the individual has been issued a visa 20 or other documentation, revocation, in accord-21 ance with section 221(i) of the Immigration and 22 Nationality Act (8 U.S.C. 1201(i)), of the visa or 23 other documentation. 24 (2) B LOCKING OF PROPERTY .—The blocking, in 25 accordance with the International Emergency Eco-26 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00033 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 34 •S 1829 RS nomic Powers Act (50 U.S.C. 1701 et seq.), of all 1 transactions in all property and interests in property 2 of a foreign person if such property and interests in 3 property are in the United States, come within the 4 United States, or are or come within the possession 5 or control of a United States person. 6 (c) E NFORCEMENT OF BLOCKING OFPROPERTY.—A 7 person that violates, attempts to violate, conspires to vio-8 late, or causes a violation of a sanction described in sub-9 section (b)(2) that is imposed by the President or any regu-10 lation, license, or order issued to carry out such a sanction 11 shall be subject to the penalties set forth in subsections (b) 12 and (c) of section 206 of the International Emergency Eco-13 nomic Powers Act (50 U.S.C. 1705) to the same extent as 14 a person that commits an unlawful act described in sub-15 section (a) of that section. 16 (d) W AIVER.— 17 (1) I N GENERAL.—The President may waive the 18 application of sanctions under this section for renew-19 able periods not to exceed 180 days if the President— 20 (A) determines that such a waiver is in the 21 vital national security interests of the United 22 States; and 23 (B) not less than 15 days before the grant-24 ing of the waiver, submits to the appropriate 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00034 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 35 •S 1829 RS congressional committees a notice of and jus-1 tification for the waiver. 2 (e) T ERMINATION ANDSUNSET.— 3 (1) T ERMINATION OF SANCTIONS.—The President 4 may terminate the application of sanctions under this 5 section with respect to a person if the President deter-6 mines and reports to the appropriate congressional 7 committees not later than 15 days before the termi-8 nation of the sanctions that— 9 (A) credible information exists that the per-10 son did not engage in the activity for which 11 sanctions were imposed; 12 (B) the person has credibly demonstrated a 13 significant change in behavior, has paid an ap-14 propriate consequence for the activity for which 15 sanctions were imposed, and has credibly com-16 mitted to not engage in an activity described in 17 subsection (a) in the future; or 18 (C) the termination of the sanctions is in 19 the vital national security interests of the United 20 States. 21 (2) S UNSET.—The requirement to impose sanc-22 tions under this section shall terminate on the date 23 that is 4 years after the date of the enactment of this 24 Act. 25 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00035 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 36 •S 1829 RS SEC. 9. RESOURCES FOR SANCTIONS IMPLEMENTATION AT 1 THE DEPARTMENT OF STATE. 2 (a) S ENSE OFCONGRESS.—It is the sense of Congress 3 that sanctions are a vital foreign policy and national secu-4 rity tool, and as such, it is critical that the Department 5 of State and other agencies with responsibilities relating to 6 sanctions across the executive branch— 7 (1) are fully staffed, including through the 8 prompt confirmation by the Senate of a qualified 9 head of the Office of Sanctions Coordination of the 10 Department of State; and 11 (2) have the resources and infrastructure nec-12 essary for the successful development and implementa-13 tion of sanctions. 14 (b) I NCREASINGRESOURCES AND IMPROVINGMOD-15 ERNIZATION FORSANCTIONSIMPLEMENTATION.—The Sec-16 retary of State shall take steps to modernize the sanctions 17 infrastructure and increase resources dedicated to imple-18 menting sanctions, including by— 19 (1) ensuring the Department of State has nec-20 essary subscriptions and access to open-source data-21 bases for purposes of making determinations to sup-22 port the designation of persons for the imposition of 23 sanctions; 24 (2) equipping bureaus involved in drafting and 25 reviewing evidentiary packages to support such des-26 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00036 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 37 •S 1829 RS ignations with sufficient technical resources to do so, 1 including an adequate number of workstations that 2 can be used to review classified information; and 3 (3) increasing the number of personnel dedicated 4 to making and reviewing such designations. 5 (c) R EPORT ONMODERNIZATIONSEFFORTS.—Not 6 later than 180 days after the date of the enactment of this 7 Act, the Secretary of State shall submit to the Committee 8 on Foreign Relations of the Senate and the Committee on 9 Foreign Affairs of the House of Representatives a report de-10 scribing steps the Department of State is taking to address 11 challenges in the ability of the Department to support the 12 designation of persons for the imposition of sanctions. 13 (d) A UTHORIZATION OF APPROPRIATION.—There is 14 authorized to be appropriated to the Secretary of State for 15 fiscal year 2025 $15,000,000 to carry out this section. 16 SEC. 10. EXCEPTIONS. 17 (a) E XCEPTIONRELATING TO IMPORTATION OF 18 G OODS.— 19 (1) I N GENERAL.—A requirement to block and 20 prohibit all transactions in all property and interests 21 in property under this Act shall not include the au-22 thority or a requirement to impose sanctions on the 23 importation of goods. 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00037 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 38 •S 1829 RS (2) GOOD.—In this subsection, the term ‘‘good’’ 1 means any article, natural or manmade substance, 2 material, supply, or manufactured product, including 3 inspection and test equipment, and excluding tech-4 nical data. 5 (b) E XCEPTIONTOCOMPLYWITHUNITEDNATIONS 6 H EADQUARTERSAGREEMENT ANDLAWENFORCEMENTAC-7 TIVITIES.—Sanctions under this Act shall not apply with 8 respect to the admission of an alien to the United States 9 if admitting or paroling the alien into the United States 10 is necessary— 11 (1) to permit the United States to comply with 12 the Agreement regarding the Headquarters of the 13 United Nations, signed at Lake Success June 26, 14 1947, and entered into force November 21, 1947, be-15 tween the United Nations and the United States, or 16 other applicable international obligations of the 17 United States; or 18 (2) to carry out or assist authorized law enforce-19 ment activity in the United States. 20 (c) E XCEPTIONTOCOMPLYWITHINTELLIGENCEAC-21 TIVITIES.—Sanctions under this Act shall not apply to any 22 activity subject to the reporting requirements under title V 23 of the National Security Act of 1947 (50 U.S.C. 3091 et 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00038 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 39 •S 1829 RS seq.) or any authorized intelligence activities of the United 1 States. 2 (d) H UMANITARIANASSISTANCE.— 3 (1) I N GENERAL.—Sanctions under this Act shall 4 not apply to— 5 (A) the conduct or facilitation of a trans-6 action for the provision of agricultural commod-7 ities, food, medicine, medical devices, humani-8 tarian assistance, or for humanitarian purposes; 9 or 10 (B) transactions that are necessary for or 11 related to the activities described in subpara-12 graph (A). 13 (2) D EFINITIONS.—In this subsection— 14 (A) A GRICULTURAL COMMODITY .—The term 15 ‘‘agricultural commodity’’ has the meaning given 16 that term in section 102 of the Agricultural 17 Trade Act of 1978 (7 U.S.C. 5602). 18 (B) M EDICAL DEVICE.—The term ‘‘medical 19 device’’ has the meaning given the term ‘‘device’’ 20 in section 201 of the Federal Food, Drug, and 21 Cosmetic Act (21 U.S.C. 321). 22 (C) M EDICINE.—The term ‘‘medicine’’ has 23 the meaning given the term ‘‘drug’’ in section 24 VerDate Sep 11 2014 06:21 May 08, 2024 Jkt 049200 PO 00000 Frm 00039 Fmt 6652 Sfmt 6203 E:\BILLS\S1829.RS S1829 kjohnson on DSK7ZCZBW3PROD with $$_JOB 40 •S 1829 RS 201 of the Federal Food, Drug, and Cosmetic Act 1 (21 U.S.C. 321). 2 (e) R ULE OFCONSTRUCTION.—Nothing in this Act 3 shall be construed to affect the availability of any existing 4 authorities to issue waivers, exceptions, exemptions, li-5 censes, or other authorization. 6 (f) A NNUALREPORT.—Not later than 1 year after the 7 date of the enactment of this Act, and annually thereafter, 8 the President shall submit to the appropriate congressional 9 committees a report that describes each activity that would 10 be sanctionable under this Act if not excepted pursuant to 11 subsections (b) and (c). 12 SEC. 11.
