2525 This Act may be cited as the ‘‘Whole Milk for 4
2626 Healthy Kids Act of 2023’’. 5

3131 Section 9(a)(2) of the Richard B. Russell National 2
3232 School Lunch Act (42 U.S.C. 1758(a)(2)(A)) is amend-3

3434 (1) in subparagraph (A)— 5
3535 (A) in clause (i), by striking ‘‘milk.’’ in the 6
3636 first sentence and all that follows through ‘‘(7 7
3737 U.S.C. 5341);’’ and inserting ‘‘milk;’’; and 8
3838 (B) in clause (ii), by inserting ‘‘whole, re-9
3939 duced-fat, low-fat, and fat-free’’ after 10
4040 ‘‘unflavored’’; and 11
4141 (2) by adding at the end the following: 12
4242 ‘‘(D) S
4343 ATURATED FAT.—Milk fat included 13
4444 in any fluid milk provided under subparagraph 14
4545 (A) shall not be considered saturated fat for 15
4646 purposes of measuring compliance with the al-16
4747 lowable average saturated fat content of a meal 17
4848 under section 210.10 of title 7, Code of Federal 18
4949 Regulations (or successor regulations).’’. 19
