A BILL
To amend the Richard B. Russell National School Lunch
Act to allow schools that participate in the school lunch
program to serve whole milk, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Whole Milk for 4
Healthy Kids Act of 2023’’. 5

SEC. 2. WHOLE MILK PERMISSIBLE. 1
Section 9(a)(2) of the Richard B. Russell National 2
School Lunch Act (42 U.S.C. 1758(a)(2)(A)) is amend-3
ed— 4
(1) in subparagraph (A)— 5
(A) in clause (i), by striking ‘‘milk.’’ in the 6
first sentence and all that follows through ‘‘(7 7
U.S.C. 5341);’’ and inserting ‘‘milk;’’; and 8
(B) in clause (ii), by inserting ‘‘whole, re-9
duced-fat, low-fat, and fat-free’’ after 10
‘‘unflavored’’; and 11
(2) by adding at the end the following: 12
‘‘(D) S
ATURATED FAT.—Milk fat included 13
in any fluid milk provided under subparagraph 14
(A) shall not be considered saturated fat for 15
purposes of measuring compliance with the al-16
lowable average saturated fat content of a meal 17
under section 210.10 of title 7, Code of Federal 18
Regulations (or successor regulations).’’. 19
