1818 This Act may be cited as the ‘‘Enhancing Spaceport 4
1919 Operations Act’’. 5
2020 SEC. 2. SPECIAL AUTHORITY FOR PROVISION OF COMMER-6

2323 NGENERAL.—Chapter 135 of title 10, United 8
2424 States Code, is amended by inserting after section 2276 9

3131 ‘‘(a) I
3232 NGENERAL.—The Secretary of a military de-3
3333 partment, pursuant to the authority provided by this sec-4
3434 tion and any other provision of law, may support Federal 5
3535 and commercial space launch capacity on any domestic 6
3636 real property under the control of the Secretary through 7
3737 the provision of space launch support services. 8

3939 ROVISION OFLAUNCHEQUIPMENT ANDSERV-9
4040 ICES TOCOMMERCIALENTITIES.— 10
4141 ‘‘(1) A
4242 GREEMENT AUTHORITY .— 11
4343 ‘‘(A) I
4444 N GENERAL.—The Secretary con-12
4545 cerned may enter into a contract, or conduct 13
4646 any other transaction, with a commercial entity 14
4747 that intends to conduct space launch activities 15
4848 on a military installation under the jurisdiction 16
4949 of the Secretary, including a contract or other 17
5050 transaction for the provision of supplies, serv-18
5151 ices, equipment, and construction needed for 19
5252 commercial space launch. 20
5353 ‘‘(B) N
5454 ONDELEGATION.—The Secretary 21
5555 may not delegate the authority provided in sub-22
5656 paragraph (A). 23

6767 or conducting the transaction to reimburse the 3
6868 Department of Defense for all direct costs to 4
6969 the United States that are associated with the 5
7070 goods, services, and equipment provided to the 6
7171 commercial entity under the contract or trans-7
7272 action. 8
7373 ‘‘(B) I
7474 NDIRECT COSTS.—A contract en-9
7575 tered into, or a transaction conducted, under 10
7676 paragraph (1) may— 11
7777 ‘‘(i) include a provision that requires 12
7878 the commercial entity to reimburse the De-13
7979 partment of Defense for such indirect costs 14
8080 as the Secretary concerned considers to be 15
8181 fair and reasonable; and 16
8282 ‘‘(ii) provide for the recovery of indi-17
8383 rect costs through establishment of a rate, 18
8484 fixed price, or similar mechanism the Sec-19
8585 retary concerned considers to be fair and 20
8686 reasonable. 21

8888 ETENTION OF FUNDS COLLECTED FROM 22
8989 COMMERCIAL USERS .—Amounts collected from a 23
9090 commercial entity under paragraph (2) shall be cred-24
9191 ited to the appropriation accounts under which the 25

9898 EGULATIONS.—The Secretary shall pro-3
9999 mulgate regulations to carry out this subsection. 4

101101 EFINITIONS.—In this section: 5
102102 ‘‘(1) S
103103 PACE LAUNCH.—The term ‘space launch’ 6
104104 includes all activities, supplies, equipment, facilities, 7
105105 and services supporting launch preparation, launch, 8
106106 reentry, recovery, and other launch-related activities 9
107107 for the payload and the space transportation vehicle. 10
108108 ‘‘(2) C
109109 OMMERCIAL ENTITY; COMMERCIAL.—The 11
110110 terms ‘commercial entity’ and ‘commercial’ means a 12
111111 non-Federal entity organized under the laws of the 13
112112 United States or of any jurisdiction within the 14
113113 United States.’’. 15

115115 LERICALAMENDMENT.—The table of sections 16
116116 for chapter 135 of title 10, United States Code, is amend-17
117117 ed by inserting after the item relating to section 2276 the 18
118118 following: 19
119119 ‘‘2276a. Special authority for provision of commercial space launch support serv-
120120 ices.’’.
