15	15	Be it enacted by the Senate and House of Representa-1
16	16	tives of the United States of America in Congress assembled, 2
17	17	SECTION 1. SHORT TITLE. 3
18	18	This Act may be cited as the ‘‘Enhancing Spaceport 4
19	19	Operations Act’’. 5
20	20	SEC. 2. SPECIAL AUTHORITY FOR PROVISION OF COMMER-6
21	21	CIAL SPACE LAUNCH SUPPORT SERVICES. 7
22	22	(a) I
23	23	NGENERAL.—Chapter 135 of title 10, United 8
24	24	States Code, is amended by inserting after section 2276 9
25	25	the following new section: 10

29	29	‘‘§ 2276a. Special authority for provision of commer-1
30	30	cial space launch support services 2
31	31	‘‘(a) I
32	32	NGENERAL.—The Secretary of a military de-3
33	33	partment, pursuant to the authority provided by this sec-4
34	34	tion and any other provision of law, may support Federal 5
35	35	and commercial space launch capacity on any domestic 6
36	36	real property under the control of the Secretary through 7
37	37	the provision of space launch support services. 8
38	38	‘‘(b) P
39	39	ROVISION OFLAUNCHEQUIPMENT ANDSERV-9
40	40	ICES TOCOMMERCIALENTITIES.— 10
41	41	‘‘(1) A
42	42	GREEMENT AUTHORITY .— 11
43	43	‘‘(A) I
44	44	N GENERAL.—The Secretary con-12
45	45	cerned may enter into a contract, or conduct 13
46	46	any other transaction, with a commercial entity 14
47	47	that intends to conduct space launch activities 15
48	48	on a military installation under the jurisdiction 16
49	49	of the Secretary, including a contract or other 17
50	50	transaction for the provision of supplies, serv-18
51	51	ices, equipment, and construction needed for 19
52	52	commercial space launch. 20
53	53	‘‘(B) N
54	54	ONDELEGATION.—The Secretary 21
55	55	may not delegate the authority provided in sub-22
56	56	paragraph (A). 23

58	58	GREEMENT COSTS.— 24

60	60	IRECT COSTS.—A contract entered 25
61	61	into, or a transaction conducted, under para-26

65	65	graph (1) shall include a provision that requires 1
66	66	the commercial entity entering into the contract 2
67	67	or conducting the transaction to reimburse the 3
68	68	Department of Defense for all direct costs to 4
69	69	the United States that are associated with the 5
70	70	goods, services, and equipment provided to the 6
71	71	commercial entity under the contract or trans-7
72	72	action. 8
73	73	‘‘(B) I
74	74	NDIRECT COSTS.—A contract en-9
75	75	tered into, or a transaction conducted, under 10
76	76	paragraph (1) may— 11
77	77	‘‘(i) include a provision that requires 12
78	78	the commercial entity to reimburse the De-13
79	79	partment of Defense for such indirect costs 14
80	80	as the Secretary concerned considers to be 15
81	81	fair and reasonable; and 16
82	82	‘‘(ii) provide for the recovery of indi-17
83	83	rect costs through establishment of a rate, 18
84	84	fixed price, or similar mechanism the Sec-19
85	85	retary concerned considers to be fair and 20
86	86	reasonable. 21
87	87	‘‘(3) R
88	88	ETENTION OF FUNDS COLLECTED FROM 22
89	89	COMMERCIAL USERS .—Amounts collected from a 23
90	90	commercial entity under paragraph (2) shall be cred-24
91	91	ited to the appropriation accounts under which the 25

96	96	rect) were incurred. 2
97	97	‘‘(4) R
98	98	EGULATIONS.—The Secretary shall pro-3
99	99	mulgate regulations to carry out this subsection. 4
100	100	‘‘(c) D
101	101	EFINITIONS.—In this section: 5
102	102	‘‘(1) S
103	103	PACE LAUNCH.—The term ‘space launch’ 6
104	104	includes all activities, supplies, equipment, facilities, 7
105	105	and services supporting launch preparation, launch, 8
106	106	reentry, recovery, and other launch-related activities 9
107	107	for the payload and the space transportation vehicle. 10
108	108	‘‘(2) C
109	109	OMMERCIAL ENTITY; COMMERCIAL.—The 11
110	110	terms ‘commercial entity’ and ‘commercial’ means a 12
111	111	non-Federal entity organized under the laws of the 13
112	112	United States or of any jurisdiction within the 14
113	113	United States.’’. 15

115	115	LERICALAMENDMENT.—The table of sections 16
116	116	for chapter 135 of title 10, United States Code, is amend-17
117	117	ed by inserting after the item relating to section 2276 the 18
118	118	following: 19
119	119	‘‘2276a. Special authority for provision of commercial space launch support serv-
120	120	ices.’’.
