1616 SECTION 1. SHORT TITLE. 3
1717 This Act may be cited as the ‘‘Combat Power Preser-4
1818 vation Act of 2023’’. 5
1919 SEC. 2. LIMITATION ON AVAILABILITY OF FUNDS FOR DE-6
2020 STRUCTION OF LANDMINES. 7
2121 (a) L
2222 IMITATION.—Except as provided in subsection 8
2323 (b), none of the funds authorized to be appropriated by 9
2424 this Act or otherwise made available for fiscal year 2024 10
2525 for the Department of Defense may be obligated or ex-11

3333 XCEPTION FORSAFETY.—Subsection (a) shall 4
3434 not apply to any anti-personnel landmine munitions that 5
3535 the Secretary of Defense determines are unsafe or could 6
3636 pose a safety risk to the United States Armed Forces if 7
3737 not demilitarized or destroyed. 8

3939 EPORTREQUIRED.— 9
4040 (1) I
4141 N GENERAL.—Not later than one year 10
4242 after the date of the enactment of this Act, the Sec-11
4343 retary of Defense shall submit to the congressional 12
4444 defense committees a report that includes each of 13
4545 the following: 14
4646 (A) A description of the policy of the De-15
4747 partment of Defense regarding the use of anti- 16
4848 personnel landmines, including methods for 17
4949 commanders to seek waivers to use such muni-18
5050 tions. 19
5151 (B) Projections covering the period of 10 20
5252 years following the date of the report of— 21
5353 (i) the inventory levels for all anti-per-22
5454 sonnel landmine munitions, taking into ac-23
5555 count future production of anti-personnel 24
5656 landmine munitions, any plans for demili-25

6060 tarization of such munitions, the age of the 1
6161 munitions, storage and safety consider-2
6262 ations, and any other factors that are ex-3
6363 pected to impact the size of the inventory; 4
6464 (ii) the cost to achieve the inventory 5
6565 levels projected in clause (i), including the 6
6666 cost for potential demilitarization or dis-7
6767 posal of such munitions; and 8
6868 (iii) the cost to develop and produce 9
6969 new anti-personnel landmine munitions the 10
7070 Secretary determines are necessary to meet 11
7171 the demands of operational plans. 12
7272 (C) An assessment by the Chairman of the 13
7373 Joint Chiefs of Staff of the effects of the inven-14
7474 tory levels projected under subparagraph (B)(i) 15
7575 on operational plans. 16
7676 (D) Any inputs by the Chairman and the 17
7777 commanders of the combatant commands to a 18
7878 policy process that resulted in a change in land-19
7979 mine policy during the calendar year preceding 20
8080 the date of the enactment of this Act. 21
8181 (E) Any other matters that the Secretary 22
8282 determines appropriate for inclusion in the re-23
8383 port. 24

8787 (2) FORM OF REPORT.—The report required by 1
8888 paragraph (1) shall be submitted in unclassified 2
8989 form, but may include a classified annex. 3

9393 N GENERAL.—Not later than 180 days 5
9494 after the date of the enactment of this Act, the Sec-6
9595 retary of Defense shall provide to the congressional 7
9696 defense committees a briefing on the status, as of 8
9797 the date of the briefing, of research and development 9
9898 into operational alternatives to anti-personnel land-10
9999 mine munitions. 11

101101 ORM OF BRIEFING.—The briefing required 12
102102 by paragraph (1) may contain classified information. 13

104104 NTI-PERSONNELLANDMINEMUNITIONSDE-14
105105 FINED.—In this section, the term ‘‘anti-personnel land-15
106106 mine munitions’’ includes anti-personnel landmines and 16
107107 submunitions, as defined by the Convention on the Prohi-17
108108 bition of the Use, Stockpiling, Production and Transfer 18
109109 of Anti-Personnel Mines and on their Destruction, con-19
110110 cluded at Oslo September 18, 1997, as determined by the 20
111111 Secretary. 21
