To limit the availability of funds for the destruction of 
landmines. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Combat Power Preser-4
vation Act of 2023’’. 5
SEC. 2. LIMITATION ON AVAILABILITY OF FUNDS FOR DE-6
STRUCTION OF LANDMINES. 7
(a) L
IMITATION.—Except as provided in subsection 8
(b), none of the funds authorized to be appropriated by 9
this Act or otherwise made available for fiscal year 2024 10
for the Department of Defense may be obligated or ex-11

pended for the destruction of anti-personnel landmine mu-1
nitions before the date on which the Secretary of Defense 2
submits the report required by subsection (c). 3
(b) E
XCEPTION FORSAFETY.—Subsection (a) shall 4
not apply to any anti-personnel landmine munitions that 5
the Secretary of Defense determines are unsafe or could 6
pose a safety risk to the United States Armed Forces if 7
not demilitarized or destroyed. 8
(c) R
EPORTREQUIRED.— 9
(1) I
N GENERAL.—Not later than one year 10
after the date of the enactment of this Act, the Sec-11
retary of Defense shall submit to the congressional 12
defense committees a report that includes each of 13
the following: 14
(A) A description of the policy of the De-15
partment of Defense regarding the use of anti- 16
personnel landmines, including methods for 17
commanders to seek waivers to use such muni-18
tions. 19
(B) Projections covering the period of 10 20
years following the date of the report of— 21
(i) the inventory levels for all anti-per-22
sonnel landmine munitions, taking into ac-23
count future production of anti-personnel 24
landmine munitions, any plans for demili-25

tarization of such munitions, the age of the 1
munitions, storage and safety consider-2
ations, and any other factors that are ex-3
pected to impact the size of the inventory; 4
(ii) the cost to achieve the inventory 5
levels projected in clause (i), including the 6
cost for potential demilitarization or dis-7
posal of such munitions; and 8
(iii) the cost to develop and produce 9
new anti-personnel landmine munitions the 10
Secretary determines are necessary to meet 11
the demands of operational plans. 12
(C) An assessment by the Chairman of the 13
Joint Chiefs of Staff of the effects of the inven-14
tory levels projected under subparagraph (B)(i) 15
on operational plans. 16
(D) Any inputs by the Chairman and the 17
commanders of the combatant commands to a 18
policy process that resulted in a change in land-19
mine policy during the calendar year preceding 20
the date of the enactment of this Act. 21
(E) Any other matters that the Secretary 22
determines appropriate for inclusion in the re-23
port. 24

(2) FORM OF REPORT.—The report required by 1
paragraph (1) shall be submitted in unclassified 2
form, but may include a classified annex. 3
(d) B
RIEFINGREQUIRED.— 4
(1) I
N GENERAL.—Not later than 180 days 5
after the date of the enactment of this Act, the Sec-6
retary of Defense shall provide to the congressional 7
defense committees a briefing on the status, as of 8
the date of the briefing, of research and development 9
into operational alternatives to anti-personnel land-10
mine munitions. 11
(2) F
ORM OF BRIEFING.—The briefing required 12
by paragraph (1) may contain classified information. 13
(e) A
NTI-PERSONNELLANDMINEMUNITIONSDE-14
FINED.—In this section, the term ‘‘anti-personnel land-15
mine munitions’’ includes anti-personnel landmines and 16
submunitions, as defined by the Convention on the Prohi-17
bition of the Use, Stockpiling, Production and Transfer 18
of Anti-Personnel Mines and on their Destruction, con-19
cluded at Oslo September 18, 1997, as determined by the 20
Secretary. 21
