23	18		Be it enacted by the Senate and House of Representa-1
24	19		tives of the United States of America in Congress assembled, 2
25	20		SECTION 1. SHORT TITLE. 3
26	21		This Act may be cited as the ‘‘WaterSMART Access 4
27	22		for Tribes Act’’. 5

32	27		OF COSTS OF CERTAIN WATER MANAGEMENT 2
33	28		IMPROVEMENTS FOR INDIAN TRIBES. 3
34	29		Section 9504(a)(3)(E)(i) of the Omnibus Public 4
35	30		Land Management Act of 2009 (42 U.S.C. 5
36	31		10364(a)(3)(E)(i)) is amended— 6
37	32		(1) in subclause (I), by striking ‘‘subclause 7
38	33		(II)’’ and inserting ‘‘subclauses (II) and (III)’’; and 8
39	34		(2) by adding at the end the following: 9
40	35		‘‘(III) W
41	36		AIVER; REDUCTION.— 10
42	37		With respect to a grant or other 11
43	38		agreement entered into under para-12
44	39		graph (1) between the Secretary and 13
45	40		an Indian tribe, the Secretary may re-14
46	41		duce or waive the non-Federal share 15
47	42		of the cost of any infrastructure im-16
48	43		provement or activity that is the sub-17
49	44		ject of the grant or other agreement if 18
50	45		the Secretary determines that con-19
51	46		tribution of the non-Federal share 20
52	47		would result in a financial hardship 21
53	48		for the Indian tribe.’’. 22
