and efficiency grants, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘WaterSMART Access 4
for Tribes Act’’. 5

SEC. 2. REDUCTION OR WAIVER OF NON-FEDERAL SHARE 1
OF COSTS OF CERTAIN WATER MANAGEMENT 2
IMPROVEMENTS FOR INDIAN TRIBES. 3
Section 9504(a)(3)(E)(i) of the Omnibus Public 4
Land Management Act of 2009 (42 U.S.C. 5
10364(a)(3)(E)(i)) is amended— 6
(1) in subclause (I), by striking ‘‘subclause 7
(II)’’ and inserting ‘‘subclauses (II) and (III)’’; and 8
(2) by adding at the end the following: 9
‘‘(III) W
AIVER; REDUCTION.— 10
With respect to a grant or other 11
agreement entered into under para-12
graph (1) between the Secretary and 13
an Indian tribe, the Secretary may re-14
duce or waive the non-Federal share 15
of the cost of any infrastructure im-16
provement or activity that is the sub-17
ject of the grant or other agreement if 18
the Secretary determines that con-19
tribution of the non-Federal share 20
would result in a financial hardship 21
for the Indian tribe.’’. 22
