16	16	rules for housing or transportation based on gender and
17	17	to provide for a limitation on gender-related medical
18	18	treatment.
19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Prison Rape Preven-4
23	23	tion Act of 2025’’. 5

30	30	Section 3621 of title 18, United States Code, is 4
31	31	amended by adding at the end the following: 5
32	32	‘‘(j) R
33	33	ULES FOR HOUSING OR TRANSPORTATION 6
34	34	B
35	35	ASED ONGENDER; LIMITATION ONGENDER-AFFIRMING 7
36	36	C
37	37	ARE.—Notwithstanding any other provision of law, the 8
38	38	Bureau of Prisons— 9
39	39	‘‘(1) shall ensure that a prisoner is placed, dur-10
40	40	ing that prisoner’s term of imprisonment, only 11
41	41	among prisoners of the same biological sex as the 12
42	42	prisoner; 13
43	43	‘‘(2) shall ensure that a prisoner, when trans-14
44	44	ported in the company of other prisoners, is only 15
45	45	transported among prisoners of the same biological 16
46	46	sex as the prisoner; and 17
47	47	‘‘(3) may not furnish or pay for any gender-re-18
48	48	lated medical treatment. 19
49	49	‘‘(k) D
50	50	EFINITIONS.—For purposes of subsection (j): 20
51	51	‘‘(1) B
52	52	IOLOGICAL SEX.—The term ‘biological 21
53	53	sex’ means the biological determination as to wheth-22
54	54	er an individual is male or female. 23
55	55	‘‘(2) F
56	56	EMALE.—The term ‘female’ means an in-24
57	57	dividual who naturally has, had, will have, or would 25
58	58	have, but for a developmental or genetic anomaly or 26

66	66	ALE.—The term ‘male’ means an indi-4
67	67	vidual who naturally has, had, will have, or would 5
68	68	have, but for a developmental or genetic anomaly or 6
69	69	historical accident, the reproductive system that at 7
70	70	some point produces, transports, and utilizes sperm 8
71	71	for fertilization. 9

73	73	ENDER.—The term ‘gender’— 10
74	74	‘‘(A) means— 11
75	75	‘‘(i) males, females, or the natural dif-12
76	76	ferences between males and females, unless 13
77	77	such term is otherwise specified or used 14
78	78	alone (rather than with or as an adjective 15
79	79	modifying other words); and 16
80	80	‘‘(ii) a synonym for sex; and 17
81	81	‘‘(B) does not mean a synonym for terms 18
82	82	or ideas such as gender identity, experienced 19
83	83	gender, gender expression, or gender roles 20

86	86	MENT.—The term ‘gender-related medical treat-22
87	87	ment’— 23
88	88	‘‘(A) means— 24

132	132	Federal Bureau of Prisons, that may 13
133	133	be provided for purposes of addressing 14

137	137	‘‘(ii) with respect to a male individual, 18
138	138	medical treatments provided for purposes 19
139	139	of addressing the perception of such indi-20
140	140	vidual that the gender or sex of such indi-21

176	176	ment, identified by the Director of the 2
177	177	Federal Bureau of Prisons, that may 3
178	178	be provided for purposes of addressing 4
179	179	the perception of such individual that 5
180	180	the gender or sex of such individual is 6
181	181	not male; and 7
182	182	‘‘(B) does not include any medical 8
183	183	treament performed on an individual for the 9
184	184	purposes of treating— 10
185	185	‘‘(i) a disorder of sex development, di-11
186	186	agnosed by a physician after such physi-12
187	187	cian has determined through genetic or 13
188	188	biochemical testing that such individual 14
189	189	does not have normal sex chromosome 15
190	190	structure, sex steroid hormone production, 16
191	191	or sex steroid hormone action; 17
192	192	‘‘(ii) irresolvably ambiguous biological 18
193	193	sex characteristics of such individual, in-19
194	194	cluding the presence of— 20
195	195	‘‘(I) 46 XX chromosomes with 21
196	196	virilization; 22
197	197	‘‘(II) 46 XY chromosomes with 23
198	198	undervirilization; or 24
