A BILL 
To amend title 18, United States Code, to provide for certain 
rules for housing or transportation based on gender and 
to provide for a limitation on gender-related medical 
treatment. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Prison Rape Preven-4
tion Act of 2025’’. 5

Section 3621 of title 18, United States Code, is 4
amended by adding at the end the following: 5
‘‘(j) R
ULES FOR HOUSING OR TRANSPORTATION 6

ASED ONGENDER; LIMITATION ONGENDER-AFFIRMING 7
C
ARE.—Notwithstanding any other provision of law, the 8
Bureau of Prisons— 9
‘‘(1) shall ensure that a prisoner is placed, dur-10
ing that prisoner’s term of imprisonment, only 11
among prisoners of the same biological sex as the 12
prisoner; 13
‘‘(2) shall ensure that a prisoner, when trans-14
ported in the company of other prisoners, is only 15
transported among prisoners of the same biological 16
sex as the prisoner; and 17
‘‘(3) may not furnish or pay for any gender-re-18
lated medical treatment. 19
‘‘(k) D
EFINITIONS.—For purposes of subsection (j): 20
‘‘(1) B
IOLOGICAL SEX.—The term ‘biological 21
sex’ means the biological determination as to wheth-22
er an individual is male or female. 23
‘‘(2) F
EMALE.—The term ‘female’ means an in-24
dividual who naturally has, had, will have, or would 25
have, but for a developmental or genetic anomaly or 26

historical accident, the reproductive system that at 1
some point produces, transports, and utilizes eggs 2
for fertilization. 3
‘‘(3) M
ALE.—The term ‘male’ means an indi-4
vidual who naturally has, had, will have, or would 5
have, but for a developmental or genetic anomaly or 6
historical accident, the reproductive system that at 7
some point produces, transports, and utilizes sperm 8
for fertilization. 9
‘‘(4) G
ENDER.—The term ‘gender’— 10
‘‘(A) means— 11
‘‘(i) males, females, or the natural dif-12
ferences between males and females, unless 13
such term is otherwise specified or used 14
alone (rather than with or as an adjective 15
modifying other words); and 16
‘‘(ii) a synonym for sex; and 17
‘‘(B) does not mean a synonym for terms 18
or ideas such as gender identity, experienced 19
gender, gender expression, or gender roles 20
‘‘(5) G
ENDER-RELATED MEDICAL TREAT -21
MENT.—The term ‘gender-related medical treat-22
ment’— 23
‘‘(A) means— 24

‘‘(i) with respect to a female indi-1
vidual, medical treatments provided for 2
purposes of addressing the perception of 3
such individual that the gender or sex of 4
such individual is not female, including— 5
‘‘(I) surgical procedures, includ-6
ing— 7
‘‘(aa) vaginectomy; 8
‘‘(bb) hysterectomy; 9
‘‘(cc) oophorectomy; 10
‘‘(dd) reconstruction of the 11
urethra; 12
‘‘(ee) metoidioplasty; 13
‘‘(ff) phalloplasty; 14
‘‘(gg) salpingo- 15
oophorectomy; 16
‘‘(hh) scrotoplasty; 17
‘‘(ii) implantation of erection 18
or testicular protheses; 19
‘‘(jj) subcutaneous mastec-20
tomy; 21
‘‘(kk) vocal cord surgery; 22
‘‘(ll) pectoral implants; and 23
‘‘(mm) penile transplan-24
tation; 25

‘‘(II) exogenous doses of testos-1
terone or other androgens; 2
‘‘(III) puberty blockers, includ-3
ing— 4
‘‘(aa) GnRH agonists; and 5
‘‘(bb) synthetic drugs that 6
suppress the production of estro-7
gen and progesterone or delay or 8
suppress pubertal development in 9
female individuals; and 10
‘‘(IV) such other medical treat-11
ment, identified by the Director of the 12
Federal Bureau of Prisons, that may 13
be provided for purposes of addressing 14
the perception of such individual that 15
the gender or sex of such individual is 16
not female; and 17
‘‘(ii) with respect to a male individual, 18
medical treatments provided for purposes 19
of addressing the perception of such indi-20
vidual that the gender or sex of such indi-21
vidual is not male, including— 22
‘‘(I) surgical procedures, includ-23
ing— 24
‘‘(aa) penectomy; 25

‘‘(bb) orchiectomy; 1
‘‘(cc) vaginoplasty; 2
‘‘(dd) clitoroplasty; 3
‘‘(ee) vulvoplasty; 4
‘‘(ff) augmentation 5
mammoplasty; 6
‘‘(gg) facial feminization 7
surgery; 8
‘‘(hh) vocal cord surgery; 9
‘‘(ii) chondrolaryngoplasty; 10
‘‘(jj) gluteal augmentation; 11
and 12
‘‘(kk) uterine transplan-13
tation; 14
‘‘(II) exogenous doses of estro-15
gen; 16
‘‘(III) puberty blockers, includ-17
ing— 18
‘‘(aa) GnRH agonists; and 19
‘‘(bb) synthetic drugs that 20
suppress the production of testos-21
terone or delay or suppress pu-22
bertal development in male indi-23
viduals; and 24

‘‘(IV) such other medical treat-1
ment, identified by the Director of the 2
Federal Bureau of Prisons, that may 3
be provided for purposes of addressing 4
the perception of such individual that 5
the gender or sex of such individual is 6
not male; and 7
‘‘(B) does not include any medical 8
treament performed on an individual for the 9
purposes of treating— 10
‘‘(i) a disorder of sex development, di-11
agnosed by a physician after such physi-12
cian has determined through genetic or 13
biochemical testing that such individual 14
does not have normal sex chromosome 15
structure, sex steroid hormone production, 16
or sex steroid hormone action; 17
‘‘(ii) irresolvably ambiguous biological 18
sex characteristics of such individual, in-19
cluding the presence of— 20
‘‘(I) 46 XX chromosomes with 21
virilization; 22
‘‘(II) 46 XY chromosomes with 23
undervirilization; or 24

‘‘(III) both ovarian and testicular 1
tissue; or 2
‘‘(iii) an infection, injury, disease, or 3
disorder caused or exacerbated by gender- 4
related medical treatment that was fur-5
nished to an individual.’’. 6
