15	15	To amend the Communications Act of 1934 to require disclo-
16	16	sures with respect to robocalls using artificial intelligence
17	17	and to provide for enhanced penalties for certain viola-
18	18	tions involving artificial intelligence voice or text message
19	19	impersonation, and for other purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Quashing Unwanted 4
24	24	and Interruptive Electronic Telecommunications Act’’ or 5
25	25	the ‘‘QUIET Act’’. 6

30	30	Section 227 of the Communications Act of 1934 (47 2
31	31	U.S.C. 227) is amended by adding at the end the fol-3
32	32	lowing: 4

34	34	ISCLOSUREREQUIRED FOR ROBOCALLS 5

37	37	‘‘(1) I
38	38	N GENERAL.—If a person making a 7
39	39	robocall uses artificial intelligence to emulate a 8
40	40	human being, such person shall disclose at the be-9
41	41	ginning of the call or text message the fact that arti-10
42	42	ficial intelligence is being used. 11
43	43	‘‘(2) D
44	44	EFINITIONS.—In this subsection: 12
45	45	‘‘(A) R
46	46	OBOCALL.— 13
47	47	‘‘(i) I
48	48	N GENERAL .—The term 14
49	49	‘robocall’ means a call made or text mes-15
50	50	sage sent— 16
51	51	‘‘(I) using equipment, whether 17
52	52	hardware, software, or a combination 18
53	53	thereof and including an automatic 19
54	54	telephone dialing system, that makes 20
55	55	a call or sends a text message to— 21
56	56	‘‘(aa) stored telephone num-22
57	57	bers; or 23
58	58	‘‘(bb) telephone numbers 24
59	59	produced using a random or se-25
60	60	quential number generator; or 26

68	68	IMITATION.—For purposes of 4
69	69	clause (i)(I), the term ‘robocall’ does not 5
70	70	include a call made or text message sent 6
71	71	using equipment that requires substantial 7
72	72	human intervention to make or send the 8
73	73	call or text message. 9

75	75	EXT MESSAGE.— 10
76	76	‘‘(i) I
77	77	N GENERAL.—The term ‘text 11
78	78	message’ means a message consisting of 12
79	79	text, images, sounds, or other information 13
80	80	that is transmitted to or from a device that 14
81	81	is identified as the receiving or transmit-15
82	82	ting device by means of a 10-digit tele-16
83	83	phone number, N11 service code, short 17
84	84	code telephone number, or email address, 18
85	85	or that is transmitted through application- 19
86	86	to-person messaging, and includes— 20
87	87	‘‘(I) a short message service 21
88	88	(commonly referred to as ‘SMS’) mes-22
89	89	sage; 23

100	100	IMITATION.—The term ‘text 7
101	101	message’ does not include a real-time, two- 8
102	102	way voice or video communication.’’. 9

106	106	(a) I
107	107	NGENERAL.—Section 227 of the Communica-13
108	108	tions Act of 1934 (47 U.S.C. 227), as amended by the 14
109	109	preceding provisions of this Act, is further amended by 15
110	110	adding at the end the following: 16
111	111	‘‘(l) E
112	112	NHANCEDPENALTIES FOR VIOLATIONSIN-17

114	114	ATION.—In the case of a violation of this section with re-19
115	115	spect to which the party making the call or sending the 20
116	116	text message uses artificial intelligence to impersonate an 21
117	117	individual or entity with the intent to defraud, cause 22
118	118	harm, or wrongfully obtain anything of value— 23
119	119	‘‘(1) the maximum amount of the forfeiture 24
120	120	penalty that may be imposed under subsection (b)(4) 25

124	124	or (e)(5)(A) of this section or subsection (b) of sec-1
125	125	tion 503 (as the case may be) shall be twice the 2
126	126	maximum amount that may be imposed for such vio-3
127	127	lation under such subsection without regard to this 4
128	128	subsection; and 5
129	129	‘‘(2) the maximum amount of the criminal fine 6
130	130	that may be imposed under subsection (e)(5)(B) of 7
131	131	this section or section 501 (as the case may be) shall 8
132	132	be twice the maximum amount that may be imposed 9
133	133	for such violation under such subsection or section 10
134	134	without regard to this subsection.’’. 11

136	136	PPLICABILITY.—The amendment made by sub-12
137	137	section (a) shall apply with respect to violations occurring 13
138	138	after the date of the enactment of this Act. 14
